damages claims, competition law, private international lawShrnutí Předkládaná práce se zabývá tématem uplatňování náhrady škody plynoucí z porušení soutěžního práva. Zaměřuje se obzvláště na případy, kdy je dána existence relevantního mezinárodního prvku. Prací se prolíná úvaha, že i po přijetí Směrnice o určitých pravidlech upravujících žaloby o náhradu škody podle vnitrostátního práva v případě porušení právních předpisů členských států a Evropské unie o hospodářské soutěži existují mezi právními řády jednotlivých členských států nadále významné rozdíly, které mohou do značné míry uplatňování náhrady škody ovlivnit. Práce je rozdělena do šesti kapitol, přičemž první a poslední z nich jsou obecný úvod a závěr. Druhá kapitola se zabývá vymezením soukromoprávního vymáhání soutěžního práva a jeho vztahem k mezinárodnímu právu soukromému. Třetí kapitolu lze členit do dvou relativně samostatných částí. První z nich pojednává o obecné konstrukci náhrady škody v českém občanském zákoníku a provádí základní porovnání s úpravou v Německu a Anglii. Druhá část se pak zabývá vybranými specifickými oblastmi pro soutěžní právo. Zejména aktivní legitimací žalobce, pasivní legitimací žalovaných a nastiňuje základní procesní specifika (rozdíl mezi stand alone a follow on žalobami, proces zpřístupnění důkazů upravený Směrnicí a institut hromadných žalob). 1 Abstract The thesis deals with the topic of damages claims arising from breach of competition law. In particular, it focuses on the cases in which is involved a relevant international element. The thesis reflect the thought that even after adoption of Directive on certain rules governing actions for damages under national law for infringements of the competition law provisions of the Member States and of the European Union, there are still significant differences between the legal systems of the Member States, which to a large extent affect the compensation for damages. The thesis is divided into six chapters, the first and last of which are general introduction and conclusion. The second chapter deals with the definition of private enforcement of competition law and its relation to private international law. The third chapter can be divided into two relatively separate parts. The first one deals with the general construction of damages in the Czech Civil Code and performs a basic comparison with the Germany and England. The second part deals with selected specific areas of competition law.
