patent, invention, patent proceedingsResumé Předkládaná diplomová práce pojednává o právní úpravě patentového práva v České republice. Cílem této práce je prozkoumat stávající právní úpravu zejména s ohledem na získání patentové ochrany a řízení navazujících a poukázat na možné nejasnosti a zvláštnosti tohoto řízení dané zvláštní povahou řízení ve vztahu k řízení dle správního řádu. Vzhledem ke vzájemné provázanosti hmotněprávní a procesněprávní patentové úpravy se práce zabývá i vybranými otázkami hmotněprávními. Práce je krom úvodu a závěru členěna do šesti kapitol. Kapitoly jsou pomyslně rozděleny do dvou tematických celků, kdy prvá až třetí kapitola se zabývá úvodem do problematiky patentového práva a čtvrtá až šestá kapitola představuje vlastní jádro práce. První kapitola se zabývá vymezením základních pojmů v oblasti patentového práva a práva duševního vlastnictví jako takového. Nejprve se věnuje pojmu duševní vlastnictví a na něj navazujícímu průmyslovému vlastnictví, které jsou většinově vysvětlovány výčtem předmětů spadajících do okruhu té či oné ochrany. Dále se již zaměřuje na pojmy, jako jsou patentové právo, patent a konečně i vlastním označením vynález. Submitted master thesis discusses patent law legislation in the Czech Republic. The purpose of this thesis is to examine current legislation in particular with the focus on gaining the patent protection as well as following proceedings and to point out possible uncertainties and particularities of such proceedings given by special nature of patent proceedings in relation to administrative proceedings in general. Considering the mutual bond between the substantive and procedure patent law, this thesis also deals with selected substantive issues. Except for the introduction and the conclusion the work is divided into six chapters. These chapters are notionally split in two main parts. First part consists of first three chapters and is considered to be the introduction to the issue of patent law; second part, consisting of last remaining chapters, represents the core of the thesis on its own. First chapter deals with defining the main terms in the field of patent law and intellectual property law as such.
