Euthanasie

Abstract

RESUMÉ Cílem této diplomové práce je sjednotit celkový náhled na problematiku euthanasie a asistované sebevraždy s kladením důrazu na trestní právo. Nepokouším se vyvodit závěr, zda zlegalizovat euthanasii v českém právním řádu či nikoliv, jen bych ráda nastínila možnosti právní úpravy v České republice do budoucna, a to po provedení analýzy v zemích, kde již k uzákonění v posledních letech došlo. Tato diplomová práce se skládá celkem ze šesti kapitol. Na začátek se snažím podrobně seznámit s podstatou euthanasie a s ní souvisejících pojmů, jako jsou asistovaná sebevražda, dříve vyslovená přání, dále uvádím její obvyklé dělení. Poté se zabývám historií a vývojem tohoto pojmu ve světě, jelikož k pochopení a ujasnění, je to nezbytné. Další kapitola je již věnována právní úpravě euthanasie v České republice, kde tato otázka nebyla a není právně upravena, avšak snahy o uzákonění zde určitou formou byly. V této kapitole se zabývám právní kvalifikací usmrcení na žádost a asistované sebevraždy de lege lata a úvahami de lege ferenda. Také zmiňuji názory odpůrců a příznivců k otázce euthanasie. V další kapitole uvádím kvalitní paliativní péči jako jeden z argumentů proti euthanasii. Nelze opomenout ani lékařskou etiku a její základní kámen, tedy Hippokratovu přísahu. The aim of my Master's degree thesis is to unify the total view of the question of euthanasia and assisted suicide with an emphasis on the criminal law. I am not trying to concluded if legalise euthanasia by the Czech law or not, I just would like to outline the possibility of the legislation in the Czech law for the future, after providing the analysis of the countries where euthanasia has happened legal in the last few years. This thesis consists of the six chapters. At the beginning I am trying to give a detailed description of the substance of euthanasia and other related terms as assisted suicide, do not resuscitate and then I state usual forms and divisions of euthanasia. Then I deal with the history term in the world because for understanding and clarification this is necessary. The next chapter is already about euthanasia in Czech Republic, where this question has never been legalised but there were some efforts in some forms to do that. In this chapter I am concened with a legal qualification of killing on request and assisted suicide de lege lata and de lege ferenda.
