European System of Financial Supervision, Single Supervisory Mechanism, Supervision, European Union, Macroprudential PolicyPředložená práce se zabývá uspořádáním dohledu nad finančním systémem v Evropské unii, přičemž svým obsahem i strukturou navazuje na dva hlavní dohledové pilíře - Evropský systém finančního dohledu (ESFS) a jednotný mechanismus dohledu (SSM). Kapitola první poskytuje historický přehled vývoje evropského finančního dohledu až k nedávné finanční krizi, v níž lze hledat základy motivace pro vznik současného systému. V kapitole druhé a třetí je zevrubně vysvětleno fungování ESFS i SSM, včetně interakcí s národními dohledovými orgány s důrazem na jejich vztah s Českou národní bankou. Průběžně je také poukazováno na některé kontroverzní prvky současného systému, jako je např. spíše regulatorní než dohledová povaha Evropských orgánů dohledu navzdory původním proklamacím, nízká akceschopnost těchto orgánů či částečně iluzorní požadavek evropských nařízení na kompletní nezávislost zástupců národních orgánů dohledu v evropských strukturách. Důraz na dopady na Českou republiku je patrný i z podkapitoly týkající se potenciálního připojení ČR do jednotného mechanismu dohledu. Zde docházím k závěru, že by bylo vhodné připojení až současně s přijetím eura za národní měnu a také by bylo dle mého názoru provést změny v Ústavě ČR vzhledem k nezávislosti ČNB při plnění svého ústavně zakotveného primárního cíle a...
1 Abstract This master thesis deals with the arrangement of the supervision of the financial system in the European Union. Its content and structure is strongly tied with two principal supervisory pillars - European System of Financial Supervision (ESFS) and Single Supervisory Mechanism (SSM). The first chapter starts with the historical background of the European financial supervision and proceeds to the recent global Great recession which motivated the reforms that led to the current state of the supervisory structure. The operation of the ESFS and SSM is thoroughly explained in chapters two and three respectively, moreover I cover their interaction with national supervisory authorities and special emphasis is put on the role of the Czech National Bank. Several controversial issues are also reflected in the course of the thesis, ie. rather regulatory than supervisory role of the European supervisory authorities which contradicts the initially declared intentions, their low operability or quite illusory legislative demand of extensive independence of national representatives when they stand for their respective home authorities in the European institutions.
