Private law Autonomy of will Fundamental rights and freedomsResumé Zásada autonomie vůle je považována za stěžejní zásadu ovládající všechny soukromoprávní vztahy v životě člověka. Lidé, ve smyslu soukromoprávních subjektů, mají díky ní možnost utvářet své soukromoprávní vztahy podle jejich svobodné vůle, i když v rámci jistých předem daných limitů. Princip autonomie vůle úzce souvisí se zásadou dispozitivnosti soukromého práva a dále se zásadou rovnosti, legální licence a zásadou dodržování smluv. Účelem mé diplomové práce je zařazení pojmu autonomie vůle do historického kontextu a jeho vymezení v rámci dalších zásad a institutů soukromého práva. Důležitost této zásady je dále ilustrována na konkrétních projevech autonomie vůle v našem právním řádu. Moje diplomová práce se dělí na část obecnou a část zvláštní. Obecná část se dále dělí na tři kapitoly. V té první se zabývám historickým výskytem autonomie vůle od starověku až po moderní dějiny, tedy od prvotních projevů autonomie vůle v rámci smluvního styku lidí až po jeho mezinárodní zakotvení. Ve druhé kapitole obecné části se věnuji úpravě autonomie vůle na našem území od roku 1811 až do doby po sametové revoluci. V této části se zaměřuji na specifika daných dějinných období a úprav ve vztahu k autonomii vůle i s některými konkrétními případy v rámci exkurzů jako samostatných podkapitol. The principle of autonomy of will is considered to be the crucial principle controlling all private relationships of human life. People in the sense of individuals of private law have opportunity to form their private relationships according to their free will thanks to the autonomy of will, even while within certain predetermined limits. The principle of autonomy of will is closely related to the principle of non-mandatory rule in private law and to the principle of equality, the principle of pacta sunt servanda and to the principle according to a person acts lawfully unless there is a legal rule prohibiting or curtailing that behaviour. The purpose of my thesis is to classify the term autonomy of will in its historical context and its definition in the context of other principles and institutions of private law. The importance of this principle is further illustrated by the specific expressions autonomy of will in our legal system. My thesis is composed of a general part and a special part. The general part is divided into three chapters. Chapter One deals with the historical appearance of autonomy of will from ancient times to modern history, ie from primary manifestations of autonomy of will in the contractual relationships of people to its international establishment.
