European Parliament, European elections, election thresholdPoslanci Evropského parlamentu jsou vybíráni pomocí 28 různých volebních systémů. Evropská unie stanovuje pouze několik základních pravidel, která konkretizují členské státy ve svých právních řádech. Diplomová práce "Volební systém do Evropského parlamentu" se zabývá podobnostmi i rozdíly v právních úpravách za účelem poukázání na nerovnost evropských voleb. Ve druhé části práce je komparován dílčí aspekt volebního systému, uzavírací klauzule, v Německu a České republice. Zatímco německý Spolkový ústavní soud uzavírací klauzuli zrušil nejprve v pětiprocentní, a poté i tříprocentní podobě pro rozpor se Základním zákonem, Ústavní soud České republiky ji potvrdil jako slučitelnou s ústavou. Oba soudy sice shodně judikovaly, že se jedná o zásah do principu rovnosti voleb, český soud je však názoru, že roztříštěnost orgánu by ohrožovala jeho funkceschopnost do takové míry, že je uzavírací klauzule zamezující této fragmetarizaci ospravedlnitelná. Rozhodnutí jsou komparována a jejich jednotlivé argumenty vyhodnocovány z pohledu své důvodnosti. Práce dochází k závěru, že vzhledem k současnému stavu i očekávanému vývoji má uzavírací klauzule ve volbách do Evropského parlamentu své opodstatnění. Powered by TCPDF (www.tcpdf.org)
Members of the European Parliament are chosen according to 28 different election systems. The European Union determines only few basic rules, which are concretised by member states in their law systems. Diploma thesis "Election system of European Parliament" deals with similarities and differences between these regulations in order to show inequality of European elections. In the second part of this thesis the author compares a partial aspect of the election system, election threshold in Germany and in the Czech Republic. While the Federal Constitutional Court of Germany invalidated firstly the five-percent-threshold and then even the three-percent-threshold because of its contradiction to Basic Law, the Czech Constitutional Court confirmed it as constitutional afterwards. Both courts judicated that it is a violation of election equality but in the opinion of the Czech one fragmentation of the Parliament would hinder its work with such intensity that election threshold preventing from this fragmentation is justifiable. The judgements are compared and their argumentations analysed if reasonable. This thesis comes to the conclusion, that considered the current state and predictable development election threshold has its justification. Powered by TCPDF (www.tcpdf.org)
