Collective Management, Musical Work, Copyright LawPředmětem této práce je kolektivní správa hudebních děl v České republice. Autorské právo je samostatným druhem oblasti nazývané právo duševního vlastnictví a jeho cílem je ochrana autorských děl. Nehmotná povaha těchto děl je pak důvodem jejich snížené možnosti ochrany samotnými autory. To je také důvod, proč se autoři začali sdružovat za účelem společné ochrany jejich práv a začali zakládat kolektivní správce. Díky nim mohou lépe ochraňovat svá práva a prosazovat společné zájmy. Při plnění této činnosti jednají kolektivní správci vlastním jménem avšak na účet zastupovaných autorů. Kolektivní správci zastupují zejména dva druhy majetkových práv- mechanická práva (rozmnožování, pronájem, atd.) a provozovací práva (koncerty, reprodukovaná hudba atd.). Díky celosvětovému boomu internetového pirátství příjmy z mechanických práv na počátku 21. století drasticky klesly. V souladu s tímto trendem klesl i význam mechanických práv v jejich původní podobě. Díky tomu je obsah této práce zaměřen spíše na provozovací práva, která jsou spojena se sdělováním děl veřejnosti. Význam mechanických práv se přesouvá na internet a promítá se i v rámci tzv. náhradních odměn vybíraných v souvislosti s výkonem práva na pořízení rozmnoženiny pro osobní potřebu. The subject of this thesis is Collective management of musical works in Czech Republic. Copyright law is specific area of Intellectual property law that protects copyright works. Intangible character of copyright law is the reason of lower level of possible protection by the right holders themselves. This is the reason why copyright holders unite in associations so called Collective management associations (CMA). CMA can ensure better protection than right holders themselves and push ahead their interests. CMA acts in their names but on the account of the right holders. CMA mainly protects two types of rights- mechanical rights (reproduction, renting etc.) and performing rights (concerts, background music etc.). Because of worldwide boom of internet piracy, income from mechanical rights in the beginning of 21st century drastically declined. In accordance with this trend declines the importance of mechanical rights in their original form. That's why this thesis is concern mainly on performing rights that are connected on communication to the public. The importance of mechanical rights is carrying on the internet and also on private copying levies which are also mentioned in special chapters.
