diplomatic asylum, humanitarian refuge67 Résumé Diplomatický azyl Cílem této práce je analyzovat téma diplomatického azylu ve světle faktu, že diplomatický azyl není na univerzální úrovni kodifikován a přesto je v mezinárodní praxi používán. Hlavními výzkumnými otázkami této práce jsou: Na jakém základě spočívá praxe poskytování mezinárodní ochrany ve formě diplomatického azylu ve státech, které nejsou účastny mezinárodních smluv týkajících se diplomatického azylu? Má být tato situace odlišně nazývána (např. humanitární útočiště)? Proč nejsou státy schopny nalézt kompromis nutný pro kodifikaci tématu? Jaké je pozadí této neschopnosti - nebo spíše neochoty? Diplomová práce je rozdělena do šesti hlavních kapitol, kdy každá z nich pojednává o tématu z jiného hlediska a pokouší se nalézt odpovědi na stanovené otázky. První kapitola se zabývá terminologickými otázkami za použití rozličných encyklopedií a slovníků a dospívá téměř k babylonskému zmatení jazyků. Následující kapitola se vrací zpět do historie, aby nalezla kořeny azylu a přesněji pak diplomatického azylu. Tato kapitola je dále dělena do dvou podkapitol, a to kvůli značnému rozdílu mezi vývojem diplomatického azylu v Evropě a v Latinské Americe, kde přetrval diplomatický azyl dodnes a byl dokonce i kodifikován. 68 Summary Diplomatic Asylum The aim of my thesis is to analyse the topic of diplomatic asylum in the light of the fact that diplomatic asylum is not universally codified nevertheless it is used in international practice. Main questions set for this thesis are: On what legal basis lies the practice of providing international protection in form of diplomatic asylum in countries that are not participating on international treaties concerning diplomatic asylum? Should this situation be called in different way e.g. humanitarian refuge? Why are states not able to find compromise in codifying this topic? What is a background for this inability - or rather unwillingness? The thesis is divided into six main chapters, each of them trying to deal with the topic in different point of view and trying to find answers to the above stated questions. First chapter examines terminology of the topic using different encyclopaedias and vocabularies, finding that it is nearing Babylonian confusion of tongues. The following chapter goes back in history in order to find roots of asylum and more narrowly diplomatic asylum.
