foundation, financial resourcesNadace a nadační fondy tvoří neodmyslitelnou součást neziskového sektoru v České republice, přestože procházely v novodobých dějinách složitým vývojem. Na počátku 90. let začaly nadace po téměř půlstoletí útlumu znovu vznikat bez jasné koncepce a řádu. Současný zákon o nadacích a nadačních fondech z roku 1997 měl za cíl jasně vymezit obsah jejich působnosti, stanovil však hranice velmi úzce a nadace a nadační fondy se staly jen redistributory majetku bez větších možností vyvíjet vlastní činnost. Odstranit tyto a další nedostatky stávající právní úpravy nadací a nadačních fondů má za cíl nový občanský zákoník, který s účinnosti od 1. ledna 2014 nahradí v plném rozsahu současný zákon o nadacích a nadačních fondech. Provedla jsem komparaci obou právních úprav, zabývala jsem se charakteristickými znaky nadací, dvojfázovým způsobem jejich vzniku i zániku, jejich organizační strukturou, majetkem a obecně prospěšným cílem. Po srovnání obou právních úprav jsem dospěla k závěru, že nový občanský zákoník, mimo zavedení souhrnného názvu fundace, přináší značnou liberalizaci nadačního práva. Nadace již nebudou vázány na čistě veřejně prospěšný účel, po vzoru zahraničních úprav mohou být zakládány i nadace dobročinné. Foundations and endowment funds, being a part of the non-profit sector, have their integral place in the civil sector of the Czech Republic. The main mission of foundations and endowment funds is to achieve public benefit which, under the current legislation, foundations achieve primarily by providing grants to third parties. However, they can only fulfil such purpose if they have a sufficient income. This paper aims to summarise the theoretical and practical possibilities of obtaining financial resources by foundation entities and their classification. The paper is largely influenced by the recodification of private law; upon the new Civil Code coming into effect on 1 January 2014, there will be a significant liberalisation of the foundation law and the legislation applicable to foundations and endowment funds will be completely transferred to the new legal regulation under the umbrella term "foundation". The introductory part of the paper summarises the present and future legislation applicable to foundation entities, defines their position in the civil sector, and discusses the historical development that had an impact on the current funding of foundations and endowment funds.
