Toto téma jsem si vybral, protože si myslím, že je to velice aktuální a často diskutovaná otázka nejen mezi odborníky, ale též mezi širokou veřejností. Tyto specifické instituty trestního práva umožňují rychlé, úsporné a efektivní řešení jednotlivých trestních věcí bez nutnosti užití nepodmíněného trestu odnětí svobody. Hlavním cílem této práce je poskytnout jejímu čtenáři souhrnný přehled o existujících alternativách v současném českém trestním právu, o jejich výhodách a nevýhodách, o důvodech, které vedly k jejich zakotvení do našeho právního řádu a o jiných důležitých souvisejících aspektech. Úvodní kapitola této práce pojednává o obecných otázkách účelu trestání a trestů. Podává základní informace o hlavních principech trestání a teoriích trestání, které položily základ současného systému trestní justice. Následující kapitola popisuje počátky vývoje alternativního trestání v českých zemích. V průběhu druhé poloviny 20. století přinesla restorativní justice a její zásady nové myšlenky do trestního práva. Alternatives to unconditional imprisonment Petr Horák The following thesis is concerned with alternatives to unconditional imprisonment. I have chosen this theme because I think it is very topical and frequently discussed issue not only among experts bud within the general public, too. These specific institutes of the criminal law enable quick, economical and effective solution of particular criminal cases with no need of using unconditional imprisonment. The main goal of this paper is to provide its reader with a summarizing overview about the existing alternatives in the present Czech criminal law , about their advantages and disadvantages, about the reasons which led to their implementation to our legal system and about another important related aspects. The introductory chapter of this text deals with the general issues of the purpose of sentencing and sanctions. It provides the basic information about the main principles of sentencing and the theories of sentencing which laid the foundation of contemporary system of criminal justice. The following chapter describes the beginnings of the development of alternative sentencing in Bohemia region.
