Diplomová práce se zaměřuje na oblast cizineckého práva, konkrétně na institut povolení k dlouhodobému pobytu. Vzhledem ke zvýšené mobilitě osob napříč jednotlivými státy se stále více zvyšují nároky na kvalitní legislativu v oblasti cizineckého práva. Vzhledem k rozsahu problematiky se práce věnuje pouze právní úpravě osob z tzv. 3. zemí, tedy zemí mimo Evropskou Unii. Práce si klade za cíl poskytout rozbor současné právní úpravy vstupu a pobytu cizinců na území České republiky. Hlavním záměrem je analyzovat právní předpis a poukázat na jeho možné nedostatky jak v oblasti systematičnosti tak i terminologie. Práce se dělí na dvě části. V první části se zaměřuje na současné právní předpisy v oblasti cizineckého práva a organizaci veřejné správy. Soustřeďuje se především na otázku nárokovosti rozhodnutí o udělení povolení k dlouhodobému pobytu z několika různých pohledů. Druhá část práce je zaměřená na samotný proces podání žádosti a postup správního orgánu při jejím rozhodování. Záměrem je především kritický rozbor právní úpravy v komparaci s ustálenou správní praxí.
Travel means have become easily assessable and affordable. Statistical figures have identified significant increases with regard to the movement of people across states. As a result, there is now overwhelming demands to review current legislation which governs immigration law. This thesis focuses upon immigration law, while explicitly drawing attention to the institutes that governs long-term residency permits for Immigrants entering the Czech Republic. This paper critically reviews regulation for immigrants that have citizenship from a country outside of the European Union. Furthermore, the paper will illustrate current legislation for immigrants entering the Czech Republic and applying for log-term residency. As a result, this paper will analyse current legislation and identify correlated weaknesses in both, taxonomy and terminology. The work is divided into two sections. The first section focuses upon current legislation. This includes immigration law, public organisations and associated authorities. Moreover, section two identifies weakness in relation to the administration of applicant claims and the authenticity of legal-safeguards.
