Trade mark, economic competition, industrial propertyCílem této práce je přiblížit problematiku ochranných známek v současné úpravě de lege lata, představit práva a povinnosti, které z této úpravy vyplývají a uvést je do kontextu reálného využití v hospodářské soutěži, zejména jejich uplatňování soudní cestou při porušení jinými subjekty (zejména tedy soutěžiteli). Tato diplomová práce obsahuje přímé citace i některé přejaté odborné názory, přičemž zdroje těchto citací jsou označeny v poznámce pod čarou. První kapitola této diplomové práce je teoretickým úvodem, tedy rozborem pojmu ochranných známek, národních, komunitárních a mezinárodních pramenů jejich právní úpravy a jeho historického vývoje. Druhá kapitola se zabývá funkcí ochranných známek, tedy zejména způsobem jejich využití v hospodářské soutěži, jejich užitečností z hlediska spotřebitelů a jejich dopadem na tržní hospodářství. Třetí kapitola této práce obsahuje popis registrační procedury, na níž je právní ochrana poskytovaná ochranným známkám vázána, dále konkrétní práva a povinnosti subjektů (zejména vlastníka ochranné známky a třetích osob) a některé způsoby nakládání s nimi (jde o institut licenční smlouvy a zástavního práva). Čtvrtou kapitolu považuji za jádro této práce, neboť se zabývá způsobem, jak se uvedených práv domáhat, respektive jaké konkrétní nároky vlastníku ochranné známky vznikají...
The purpose of this thesis is to outline the legal institution of trade marks in the current positive law - i.e. de lege lata, to introduce the rights and obligations granted and imposed by this legal regulation and to portray the actual usage of these in economic competition, with focus on their enforcement by suit of law in case of the infringement of these rights and obligations by third parties (most commonly competitors). This thesis contains direct citations and certain acquired professional opinions, the source of each of which is denoted in an appended footnote. The first chapter of this thesis is a theoretical introduction, comprising of the definition of trade marks, the national, community and international legal regulation of trade marks and a brief history of trademarks. The second chapter discusses the functions of trade marks, especially their uses in economic competition, their utility from the consumer's perspective and their impact on the market economy.
