Abstract

1 ABSTRAKT (EN) - LEGAL REGULATION OF .EU DOMAIN The subject of this thesis is the legal regulation of the ".eu" top level domain (.eu TLD). The opening chapters of the thesis focus on defining the concept and establishing the importance of domain names, together with their structure and various types. The thesis then goes on to consider the issue of domain names from the point of view of the Czech legal system. The thesis discusses the circumstances and reasons for the implementation of the .eu TLD and looks at the duties and responsibilities of those institutions responsible for its maintenance, the process of registering a domain name, relations between the entities involved (e.g. domain name holders or applicants for domain names and registrars), the protection of the rights of such involved entities and current .eu TLD usage trends (in particular, among EU member states). Regulation (EC) No 733/2002 and Regulation (EC) No 874/2004 are the main source materials for this thesis. However, rules issued by the competent institutions on the basis of Regulations (EC) No 733/2002 and Regulation (EC) No 874/2004 - as well as certain rulings made by the ADR (the arbitration centre for Internet disputes) - have also served as an important sources of information. 1 ABSTRAKT (CZ) - PRÁVNÍ ÚPRAVA DOMÉNY .EU Předmětem této rigorózní práce je právní úprava domény .eu. V úvodních kapitolách práce je definován pojem a význam doménových jmen, jejich struktura a druhy. Následně se práce zabývá pojetím doménových jmen z právního hlediska v rámci právního řádu České republiky a neopomíjí ani jejich ekonomické aspekty. Hlavní pozornost je věnována doméně nejvyššího řádu .eu (.eu TLD), která je popsána z hlediska okolností a důvodů jejího zavedení, institucí vykonávajících působnost v oblasti této domény, průběhu registrace doménových jmen .eu, vztahů vznikajících mezi příslušnými subjekty, poskytování ochrany práv příslušným subjektům a aktuálních tendencí využívání domény .eu v jednotlivých členských státech Evropské unie. Jako hlavní pramen pro sepsání této rigorózní práce bylo použito především nařízení (ES) č. 733/2002 a nařízení (ES) č. 874/2004. Zásadním zdrojem informací byla rovněž pravidla kompetentních institucí vydávaná na základě zmíněných nařízení (ES) a dále jednotlivá rozhodnutí ADR Centra pro řešení sporů o domény .eu. Práce hodnotí institut doménového jména z hlediska českého právního řádu a následně poskytuje relativně ucelený přehled o právní úpravě domény .eu, a to především jednotlivých fází registrace doménových jmen pod touto doménou, práv a povinností...
