Abstract

The aim of the submitted doctoral thesis entitled "International abduction of children and the European Convention for the Protection of Human Rights and Fundamental Freedoms" is to examine the issue of international child abduction from the domestic, international and European perspectives and show their interconnections. To demonstrate this, the thesis will analyze the practices of national courts, the European Court of Human Rights (hereinafter referred to as the ECHR) and the European Court of Justice (hereinafter referred to as the ECJ). Resume Klíčová slova: Mezinárodní únosy dětí, Haagská úmluva o občanskoprávních aspektech mezinárodních únosů dětí, nařízení Brusel II. bis, Evropská úmluva o ochraně lidských práv a základních svobod. Předkládaná rigorózní práce na téma: "Mezinárodní únosy dětí a Evropská úmluva o ochraně lidských práv a základních svobod" si klade za cíl nahlédnout na problematiku mezinárodních únosů dětí z pohledu vnitrostátního, mezinárodního a evropského práva a zobrazit jejich vzájemné propojení. K demonstraci uvedeného bude využita analýza judikatury národních soudů, Evropského soudu pro lidská práva (dále jen "ESLP") a Soudního dvora EU. Pozornost bude věnována zejména interpretaci jednoho z nejdůležitějších mezinárodních instrumentů mezinárodních únosů dětí - Haagské úmluvě o občanskoprávních aspektech mezinárodních únosů dětí (dále jen "Haagská úmluva") ze strany ESPL. Jelikož se případy mezinárodně unesených dětí dotýkají nejen práva na respektování rodinného života ve smyslu čl. 8 Evropské úmluvy o ochraně lidských práv a základních svobod (dále jen "EÚLP"), ale i práva na spravedlivý proces, bude rovněž věnována pozornost ustanovení čl. 6 EÚLP.
