Závěr Trest smrti jako trest nejvyšší a absolutní provází lidstvo od nepaměti a dodnes můžeme nalézt mnoho jeho zastánců i odpůrců. V této práci jsem se snažil především zdokumentovat jeho vývoj, rozebrat argumenty pro a proti tomuto trestu, případně rozebrat možnosti nahrazení absolutního trestu. Doufám, že poskytne užitečné informace k tomu, aby si případní čtenáři mé práce udělali ucelený obrázek o trestu smrti a třeba i přehodnotili svůj názor na jeho výkon. Dříve, kdy ještě nebyla úcta k lidskému životu na takové úrovni jako dnes, o trestu smrti nikdo v podstatě nepřemýšlel. Byl součástí životů lidí a tragédií se stal až v případě, že postihl konkrétního pachatele trestného činu nebo v tom horším případě nevinného. Lidé nepřemýšleli jaký vliv má tento trest na celou společnost, na potencionální pachatele trestných činů, jak ovlivňuje kriminalitu, ani na případné justiční omyly a jeho zneužívání ku prospěchu mocných. Převážně až v posledních dvou stoletích se začaly objevovat hlasy volající po jeho zrušení a stále více států tento trest odstraňovalo ze svých zákonů. A to je dobře, celá společnost se tak stává humánnější, tolerantnější, lepší. Co se týče mého názoru, vždycky jsem byl odpůrcem trestu smrti a psaní této práce a studium dokumentů, knih a názorů ostatních - ať už zastánců či odpůrců - mě...
Death penalty Death penalty is one of the most controversial sentences in the history of mankind. It was known even 2000 years B. C. and the most famous civilizations as Roman Empire or ancient Greeks were using it. Later in 19th century we can hear first strong voices demanding abolishment of death penalty. The Pioneer was Cesare Beccaria and his work Dei delitti e delle pene. Nowadays 95 countries have abolished death penalty for all crimes, 9 countries abolished it for ordinary crimes and 35 countries have death penalty among sentences but they do not use it. In Czechoslovakia there was death penalty almost through whole existence of Czechoslovakia. It was abolished not until year 1990, after "velvet revolution". Methods of executions have always been very different and they varied depending on the place and time. Among the most known belongs crucifixion, burning to death, decapitation, guillotine, hanging, gas chamber, electric chair and lethal injection. In my dissertation I have to mention two very different countries which still use capital punishment to a large extent. These are United States of America and China.
