Závěr Dnes na světě existuje více než 2600 BIT, které tvoří gros celého současného práva mezinárodních investic. Někteří autoři dokonce hovoří o tzv. BIT generaci1 . Tyto dohody jsou uzavírány mezi nejrůznějšími státy světa, ale jedno mají společné. Lze v nich vypozorovat trend k čím dál tím většímu posilování práv investorů na úkor zájmů hostitelských států. Jak již bylo zmíněno, v judikatuře posledního desetiletí lze tento trend nejnápadněji vysledovat pokud jde o standard FET. Nejen samotné BIT, nýbrž také judikatura postupně do tohoto režimu přidávala nová pravidla a ze standardů zacházení se stal mocná zbraň zahraničních investorů. Existují obavy, že státy došly příliš daleko ve snaze přitáhnout zahraniční investory za každou cenu. Teorie se shoduje na tom, že je třeba najít rovnováhu mezi ochranou práv investorů a uznáním legitimního prostoru pro činnost hostitelských států, které zodpovídají za zájmy všech, kdo žijí v jejich jurisdikci, a musí prosazovat mnoho veřejných zájmů, nejen ty investorské. Mnoho případů po celém světě včetně arbitráže podle dohody NAFTA, vzbudilo vlnu nevole. Bylo například poznamenáno, že "existující právo je skandálně neschopné vyvážit subjektivní práva s veřejnými hodnotami"2 nebo že investoři by v hostitelském státě neměli být chráněni více než ve svém vlastním.3...
Standards of foreign investor treatment Summary The purpose of my thesis is to analyse the current state of the standards of treatment in the field of international investment. The reason for my research is the dynamic growth in number of international investment disputes which appears to examine the adaptability and viability of international law. The thesis is composed of five chapters, each of them dealing with different aspects of the problems. Chapter One is introductory and deals with the general standard of non- discrimination which is common to the other chapters. Chapter Two examines the standard of fair and equitable treatment (FET). The chapter is subdivided into three parts and a conclusion. Part One explains the importance of this standard, Part Two deals with the connection of this standard to international customary law and Part Three explains the content of the FET standard. Chapter Three focuses on another important standard of treatment - the national treatment. It is subdivided into three parts and a conclusion similarly to the former chapter. Chapter Four concentrates on the most-favoured-nation clauses (MFN). The chapter consists of two parts, which investigate the significance of this specific standard and investigate its content.
