euthanasia, legal regulation of euthanasia, death with dignity, assisted suicideShrnutí Euthanasie je a stále bude žhavým tématem vzbuzujícím vášnivé debaty, jak mezi laiky, tak i odbornou veřejností. Účelem mé diplomové práce je poskytnout čtenáři informace o euthanasii a přehled právních úprav věnujících se problematice euthanasie ve vybraných zemích. V úvodu je nastíněna problematika euthanasie. Druhá kapitola je věnována objasnění obsahu pojmu euthanasie, jenž pochází z řečtiny, jde o sousloví slov "eu" znamenající dobrá a slova "thanatos" znamenající smrt, tedy "dobrá smrt", někdy se také můžeme setkat s volnějším překladem euthanasie jako krásné smrti. Obsah pojmu euthanasie se v průběhu historie měnil. Dnes chápeme euthanasii jako jednání, kterým jedna osoba úmyslně ukončí život druhé osobě na její vlastní žádost s úmyslem ukončit její utrpení. V podkapitole jsou uvedeny a definovány formy euthanasie, zejména aktivní a pasivní. Třetí kapitola pojednává o postoji Evropské unie k euthanasii. Žádný právní předpis Evropské unie výslovně euthanasii neřeší. Zdravotní politika v zásadě spadá do kompetence vlád členských států. A každý členský stát má svůj vlastní postoj k problematice euthanasie. V této kapitole se zmiňuji i o Radě Evropy, přestože není institucí Evropské unie a o jejich doporučeních. Je zde rozebrán i rozsudek Evropského soudu pro lidská práva z roku 2002 ve věci...
Résumé Euthanasia is and always will be a hot topic of very heated debate among both non specialists and experts. The purpose of my thesis is to provide the reader with information about euthanasia and a list of rules dealing with the issue of euthanasia in selected countries. The introduction outlines the problems of euthanasia. The second chapter is devoted to clarifying the content of the notion of euthanasia, which comes from the Greek word for the phrase, "eu" meaning good and "thanatos" meaning death, a "good death", sometimes we can also meet the looser translation of euthanasia as a beautiful death. The content of the notion of euthanasia in the course of history changed. Today we see euthanasia as an act which one person intentionally ends the life of another person's own request with the intent to end her suffering. In the chapter are identified and defined forms of euthanasia, especially active and passive. The third chapter deals with the European Union's attitude to euthanasia. No law of the European Union explicitly addressed the euthanasia. Health policy in principle falls within the competence of national governments.
