Tato práce pojednává o vývoji Apelačního soudu v Praze v období osvíceného a policejního absolutismu. Časový výsek, který zahrnuje, je ohraničen roky 1749 a 1850. Hlavním cílem této práce je popis, jaké postavení v soudním systému apelační soud postupně v průběhu druhé poloviny 18. století zaujímal, a jak se tereziánské a josefínské reformy promítly do složení a celkového fungování apelačního soudu. V josefínské podobě pak tento soud v zásadě fungoval až do roku 1850, tj. do své proměny ve Vrchní zemský soud v Praze. Apelační soud v Praze (Rada nad apelacemi) byl založen v roce 1548. Od počátků byl výhradně královským a tedy nestavovským soudem. Jednalo se o odvolací instanci proti rozhodnutím městských soudů. Jeho působnost (pravomoc) byla v průběhu času rozšiřována. Naopak územní působnost, která měla být zpočátku celostátní, byla v průběhu 18. století omezena pouze na Čechy. Postupně tak Apelační soud v Praze získal úlohu zemské odvolací instance, nejprve hlavně pro okruh městského soudnictví, později se všeobecnou působností. V souvislosti s nabytím úlohy obecné druhé instance se název této instituce roku 1783 mění na všeobecný apelační soud. Roku 1850 se pak tento soud...
The Court of Appeal in Bohemia between 1749 and 1790 (1850) This thesis describes the development of The Court of Appeal in Bohemia between the years 1749 and 1850. The main aim of this thesis is the description of the role of this court in the system of justice in the second half of the eighteen century and the description of the effects of reforms of Maria Theresa and Joseph II on the constitution, structure and function of the court. In the form, which the court acquired at the time of the rule of Joseph II, the court remained for another sixty years. The Court of Appeal in Bohemia was founded in the year 1548. From the beginning it was a royal court and was empowered to hear appeals of municipal courts. Its competence was extended during the ages. On the contrary the district of the court was limited during the eighteen century only to Bohemia. In the year 1850 the court was transformed into Higher Regional Court in Prague.
