Závěr Cílem mé rigorózní práce bylo pojednat o postupu notáře jako soudního komisaře od zahájení řízení o dědictví, přes zjišťování jednotlivých aktiv a pasiv, až po stanovení obvyklé ceny majetku patřícího do dědictví. Vzhledem k tomu, že dědické řízení a jeho průběh jsou ovlivňovány řadou nepředvídatelných faktorů (vztahy mezi dědici, dostupností informací o majetku apod.) nebylo možné popsat veškeré situace, které se mohou v průběhu řízení vyskytnout. Z tohoto důvodu jsem se zaměřila na standardní postupy v rámci dědického řízení, s doplněním vlastních poznatků z notářské praxe. Největší část mé práce je věnována zjišťování jednotlivých aktiv a pasiv dědictví, neboť jejich soupis je obligatorním úkonem v rámci dědického řízení, který zároveň slouží jakožto podklad pro stanovení výše obvyklé ceny majetku zůstavitele. Náležité zjištění veškerého majetku, který zůstavitel vlastnil ke dni úmrtí, je rovněž důležité z toho důvodu, aby se zamezilo situacím, kdy se po právní moci usnesení o skončení dědického řízení objeví další majetek, ohledně něhož bude nutné zahájit dodatečné dědické řízení. V této práci jsem vycházela především z odborné literatury knižní a časopisecké (zejména z časopisu Ad Notam), ze soudní judikatury, ze závěrů přijatých na školeních notářů a notářských koncipientů a z právních předpisů...
Resumé Death is an essential part of our lives. It is an important even that influences the formation, the change and the end of legal relationships. Some discretions and duties of the dead person are so closely connected with him/her that they expire after the person's death. On the contrary, discretions and duties of property character do not expire with the death of people, however, they descend on the heritor or on other subjects on the basis of a special legal regulation. There is probably nobody who does not care about his/her property after the death. For this reason there is a heirship which regulates passing of rights and responsibilities of dead people on other subjects and other law relationships that are established this way. The aim of my rigorous work is to deal with a procedure of a notary as a law commissioner from the initialisation of the inheritance, finding assets and debts up to the definition of the common price of property that is a part of the inheritance. Because of the fact that the inheritance procedure and its process are influenced by a lot of unpredictable factors (relations among the inheritors, availability of information about the property and so on), it was not possible to describe all the situations that could happen during the process.
