Abstract

Admissibility of Environmental Claims Regarding Climate Neutrality Abstract This thesis deals with the issue of the admissibility of environmental claims regarding the climate neutrality of products and services in the context of new European Union legislation related to the green transition. The main objective of the thesis is to analyze the existing legal framework in the EU, Germany, and the Czech Republic and to assess under what conditions environmental claims about climate neutrality can be considered permissible. The main research question related to this objective is: "Under what conditions can environmental claims that a product or service is climate neutral be used?" The first part of the thesis defines the concept of environmental claims, their types, and the risks of misleading practices known as greenwashing. The second chapter focuses on environmental claims about climate neutrality and analyzes the issue of carbon offsets, their functioning, and controversial aspects that may lead to confusion or consumer deception. The third chapter analyzes the legal framework of the European Union, in particular the Unfair Commercial Practices Directive, the Directive on strengthening consumer rights in the green transition, and the proposal for a directive on environmental claims. Přípustnost environmentálních tvrzení o klimatické neutralitě Abstrakt Tato diplomová práce se zabývá problematikou přípustnosti environmentálních tvrzení o klimatické neutralitě výrobků a služeb v kontextu nové legislativy Evropské unie související se zelenou transformací. Hlavním cílem práce je analyzovat stávající právní úpravu v EU, Německu a České republice a zhodnotit, za jakých podmínek lze environmentální tvrzení o klimatické neutralitě považovat za přípustné. S tímto cílem souvisí hlavní výzkumná otázka: "Za jakých podmínek je možné použít environmentální tvrzení o tom, že výrobek nebo služba je klimaticky neutrální?" Práce v první části vymezuje pojem environmentálního tvrzení, jeho druhy a rizika klamavých praktik známých jako greenwashing. Druhá kapitola se zaměřuje na environmentální tvrzení o klimatické neutralitě a rozebírá problematiku uhlíkových offsetů, jejich fungování a sporné aspekty, které mohou vést k nejasnostem nebo klamání spotřebitelů. Třetí kapitola analyzuje právní rámec Evropské unie, zejména směrnici o nekalých obchodních praktikách, směrnici o posílení postavení spotřebitelů v rámci zelené transformace a návrh směrnice o environmentálních tvrzeních.
