Dopady nové regulace u dohod konaných mimo pracovní poměr

Abstract

Tématem mé bakalářské práce je hodnocení regulace. V rámci mé práce jsem se rozhodla hodnotit regulaci dohod o pracovní činnosti, která byla upravena novelou zákoníku práce č. 281/2023 Sb. Práce je rozdělena na dvě části. První část je teoretická, druhou pak tvoří praktická část. V první části popisuji dohody o pracovní činnosti, pro jaké účely vznikly a jakým způsobem jsou využívány, jaká je jejich podoba a charakteristika. Poté popisuji, proč byly provedeny změny u dohod o pracovní činnosti a jak vypadají, jaké jsou jejich možné dopady a koho budou změny ovlivňovat. Dále se se věnuji popisu analýzy přínosů a nákladů, kde ji představuji, shrnuji její výhody a nevýhody a popisuji její postup. V praktické části pak hodnotím samotnou regulaci na základě cost-benefit analýzy, kterou jsem popsala v teoretické části. Po určení specifik pro analýzu, identifikuji a kvantifikuji dopady regulace. Následně pak na základě analýzy projekt vyhodnocuji s rozhodnutím o provedení regulace. Klíčová slova: Cost benefit analýza, DPČ, dohody konané mimo pracovní poměr, sociální dopady

The theme of my bachelor thesis is the evaluation of regulation. Within the framework of my thesis I decided to evaluate the regulation of Agreement on Work Activity, which was regulated by the amendment to the Labour Code No. 281/2023 Coll. The first part is theoretical, the second part is practical. In the first part, I describe the Agreement on Work Activity, for what purpose it was created and how it is used, what its form and characteristics are. I then describe why changes have been made to the Agreement on Work aktivity and what they look like, its possible effects and who will be affected by the changes. I then go on to describe benefit-cost analysis, introducing it, summarising its advantages and disadvantages and describing its process. In the practical part, I then evaluate the regulation itself on the basis of the cost-benefit analysis I described in the theoretical part. After determining the specifics for the analysis, I identify and quantify the impacts of the regulation. I then use the analysis to evaluate the project with the decision to implement the regulation.
