Příčiny pasivity krajských zastupitelstev v oblasti zákonodárné iniciativy

Abstract

8 Abstrakt Práce pojednává o zákonodárné iniciativě krajů v České republice. Konkrétně se soustředí na jejich pasivitu v této oblasti. Součástí práce je teoretické ukotvení zákonodárství v České republice a následně popis všech klíčových struktur, jako je legislativní iniciativa, legislativní proces či orgány krajů. Práce také pracuje s historickým kontextem vzniku krajů, čímž se pokouší najít hlubší propojení mezi kraji a vznikající legislativou. V praktické části práce nejprve definuje krajskou pasivitu a nadále označuje příčiny této pasivity. K výsledkům dochází za použití smíšeného výzkumného modelu, tedy kombinace kvantitativního a kvalitativního přístupu. Výsledkem výzkumu je potvrzení upadající frekvence využívání pravomoci kraji a označení hlavních příčin, kterými jsou využívání jiných cest k změně legislativy (meziresortní připomínkové řízení, poslanecký návrh) či nevůle předkládat zákonodárné inciativy kvůli nízké úspěšnosti a nezájmu legislativních těles. Práce dále poskytuje návrhy řešení situace a polemizuje nad budoucností zákonodárné iniciativy.

The thesis deals with the legislative initiative of regions in the Czech Republic. Specifically, it focuses on their passivity in this area. The thesis includes a theoretical anchoring of legislation in the Czech Republic and then a description of all key structures, such as the legislative initiative, the legislative process and the bodies of the regions. The thesis also works with the historical context of the creation of the regions, thus attempting to find a deeper connection between the regions and the emerging legislation. In the practical part, the thesis first defines county passivity and continues to identify the causes of this passivity. It arrives at its results using a mixed research model, a combination of quantitative and qualitative approaches. As a result, the research confirms the declining frequency of the use of powers by the counties and identifies the main causes, which are the use of other channels to change legislation (inter- ministerial comment procedure, parliamentary proposal) or the reluctance to submit legislative initiatives due to the low success rate and disinterest of legislative bodies. The paper also provides suggestions for solutions to the situation and discusses the future of legislative initiatives.
