Abstract

Diplomová práce je zaměřená na oblast právní úpravy myslivosti. Cílem diplomové práce "Právní úprava myslivosti" je shrnutí historického vývoje a legislativního rámce výkonu myslivosti od raného středověku po aktuálně účinnou právní úpravu výkonu práva myslivosti s jejím zhodnocením a promítnutím do praxe a dále s možností změn de lege ferenda. Na začátku práce je nejprve uveden přehled historického vývoje lovu a prvních právních úprav myslivosti se zaměřením na důležité právní akty dané doby, které pro myslivost představovaly zásadní změny. Další část diplomové práce je věnována současné české právní úpravě myslivosti včetně souvisejících a podzákonných právních předpisů, které ve svém souhrnu představují právní rámec myslivosti a určují pravidla pro myslivecké hospodaření. Následuje přehled mezinárodních smluv a právních předpisů Evropské unie, které se dotýkají oblasti myslivosti nebo životního prostředí. Je nutné ovšem podotknout, že žádná z mezinárodních smluv a ani žádný právní předpis Evropské unie přímo neupravuje myslivost, pouze oblasti související. Na tuto část navazuje jedna z hlavních částí práce, která shrnuje právní úpravu myslivosti České republiky a vysvětluje jednotlivé instituty myslivosti. The diploma thesis focuses on the legal regulation of hunting and gamekeeping. The aim of the diploma thesis entitled "Legal regulation of hunting" is a broad summarization of the historical development and the correlated alterations of the legislative framework in gamekeeping. In order to gain a deeper understanding of the historical context, the thesis focuses on the development of gamekeeping legislation from the early Middle Ages to presently effective legal regulation. The implicit part of the thesis is the evaluation and the reflection of the legislation applied in practice. The overall conclusion contains a proposal for possible legislative changes de lege ferenda. The first part of the thesis gives an overview of the historical development and the early legal regulations of gamekeeping, utilizing the important legal acts, which presented fundamental changes to the legal framework of gamekeeping. The following part of the diploma thesis is devoted to the current state of the Czech legal regulation of gamekeeping, including related and subordinate legislation, by which, in summary, the legal framework of gamekeeping and determination of the rules for hunting and game management are represented.
