international custom, general practice, opinio iurisRole obyčeje v mezinárodním právu veřejném ABSTRAKT Mezinárodní obyčej řadíme vedle mezinárodní smlouvy mezi jeden ze základních pramenů mezinárodního práva veřejného. I přesto, že téma mezinárodního obyčeje tvoří východisko tohoto oboru a je systematicky vyučováno již v základních kurzech mezinárodního práva, je obyčej stále v některých oblastech předmětem diskuzí. O výklad sporných oblastí se pokouší jak Mezinárodní soudní dvůr ve své judikaturní praxi, tak jiní autoři působící v mezinárodním právu veřejném a rovněž Komise OSN pro mezinárodní právo, která se na svých zasedáních zabývá mimo jiné i tématem mezinárodního obyčeje. Identifikace základních prvků obyčeje, včetně rozporuplných diskuzí ohledně role mezinárodních organizací, různé teoretické pohledy na vztah obecné praxe a opinia iuris a na vztah mezinárodní smlouvy a obyčeje, jsou klíčovými otázkami této diplomové práce. S tímto cílem uvádí tato diplomová práce v první kapitole nejdříve historický vývoj teoretických koncepcí, které se snažily popsat mezinárodní obyčej. Ve druhé a třetí kapitole se zaměřuje na podrobný popis dvou základních prvků (opinia iuris a obecné praxe), které demonstruje na příkladech judikátů Mezinárodního soudního dvora s tím, že se zabývá i rolí mezinárodních organizací a formami obecné praxe. The Role of International Custom in Public International Law ABSTRACT Besides international treaty, international custom is one of the main sources of a public international law. Although international custom is systematically taught in elementary courses of public international law and it forms the basis of this field, it still remains a subject of many discussions. Possible interpretations of international custom are provided by International Court of Justice in its case law, by other authors currently active in public international law and also by the International Law Commission, sessions of which (among other things) aim to clarify this matter. The inconsistency in the identification of the main elements of international custom, the unclear role of international organizations, different theoretical opinions concerning the relationship between general practice and opinio iuris and relationship between treaties and international custom are the core questions of this thesis. To these ends, in its first chapter this thesis firstly delineates the historical development of theoretical constructions concerning international custom.
