Restorative justice - Victim in the Criminal procedure - Diversions from ProsecutionHlavní cíl disertační práce spočívá v potvrzení či vyvrácení hypotézy, zda alternativní řešení trestních věcí a programy restorativní justice přináší pozitiva pro účastníky trestního konfliktu, především pak pro poškozeného, respektive oběť trestného činu. Z toho důvodu se práce zaměřuje na oběti trestné činnosti z pohledu restorativní justice ve snaze poznat jejich zájmy, potřeby a očekávání pramenící ze spáchání trestného činu a ve snaze poznat rovněž to, zda je trestní proces, resp. alternativní řešení trestních věcí a restorativní programy, schopen je účinně reflektovat. Práce je proto dělena do čtyř vzájemně provázaných celků. V první části se věnuje teoretické analýze konceptu restorativní justice a jejímu vztahu k justici retributivní. Dále krátce pojednává o teorii konfliktu, na což navazuje představením restorativního procesu, principů, z nichž vychází, a jeho účastníků, jimiž jsou kromě přímých aktérů trestného činu, tj. oběti a pachatele, i komunita (ve významu jejich sociálního okolí) a v neposlední řadě rovněž osoba zprostředkovatele. Vzhledem k tomu, že restorativní justice chápe trestný čin jako sociální událost negativně ovlivňující nejen jeho přímé účastníky, ale i narušující pokojný stav uvnitř společnosti, považuje tento přístup za klíčové, aby na ni bylo reagováno se zahrnutím...
The purpose of the thesis is to confirm or disprove the hypothesis whether alternative methods of crime resolution and restorative programs bring advantages and benefits to the victims of crime. For that reason I perceive the victims of crime from the Restorative justice's point of view trying to identify their interests, needs and expectations arising from the criminal event and trying to get to know whether the criminal procedure, as well as its alternatives, is able to fulfill them. Therefore the thesis is composed of four chapters, each of them dealing with different aspects of the victim from the restorative perspective. The first chapter of the thesis is dedicated to the theoretical analysis of the concept of Restorative justice. It deals with the principles of restorative and retributive paradigms and their relation, it briefly discusses the theory of conflict and describes the restorative process, its principles and the stakeholders - the victim, the offender, their communities of care or their social circles and, last but not least, the facilitator.
