Detskí vojaci v medzinárodnom práve

Abstract

Children's rights and protection principles are today's current issue which is becoming increasing public interest. The rigorous thesis, as is already clear from its title, deals with children's rights in international documents. As a goal of the thesis is the analyse of the children status and its protection in areas which are problematic and need a deeper investigation. Specific areas are divided into individual systematic chapters which are interlinked. The special emphasis is put on child soldiers in the world and individual international instruments which are providing the protection of them. The rigorous thesis deals with the relation between international humanitarian law, international conventions and depending on children's rights. The thesis is divided into eight chapters and those are divided into several subsections. The first part of the thesis deals with children participation during the armed conflicts and then who is the children solieders. An important point to be discussed at the beginning of the work is the division of the armed conflict on the international and internal armed conflict. Práva dieťaťa a zásady jeho ochrany sú i dnes aktuálnou témou, ktorá si získava stále väčší záujem verejnosti. Predkladaná práca, ako je už z jej názvu zrejmé, sa venuje fenoménu využívania detí ako detských vojakov v ozbrojených konfliktov. Ako cieľ som si vytýčila skúmať postavenie dieťaťa a jeho ochranu v oblasti ich účasti na ozbrojených konfliktoch, ktoré sú podľa môjho názoru problematické a hodné hlbšieho preskúmania. Oblasti skúmania prekladanej práce sú rozdelené v jednotlivých kapitolách, ktoré sa systematicky delia a sú vzájomné prepojené. Dôraz sa kladie na problematiku detských vojakov vo svete a jednotlivé medzinárodné inštrumenty, ktoré poskytujú ochranu takto zneužívaným deťom. Táto rigorózna práca sa zaoberá vzťahom medzinárodného humanitárneho práva a medzinárodných dohovorov v súvislosti s právami dieťaťa. Predkladaná práca sa delí na osem hlavných kapitol v rámci ktorých sa ďalej vnútorné člení na niekoľko podkapitol. Začiatok práce je venovaný účasťou detí na ozbrojených konfliktoch a následne kto pod pojem detskí vojak spadá. Dôležitým bodom, ktorý sa na začiatku práce rozoberá je aj rozdelenie ozbrojeného konfliktu na medzinárodný a vnútroštátny ozbrojený konflikt.
