Abstract

Democracy and a state governed by the rule of law The diploma thesis deals with the topics of democracy, the rule of law and their interaction. It is focused on both themes in the context of their historical development and other ideas that have influenced one or the other phenomenon. For this reason, the reader encounters primarily the issues of an ancient understanding of democracy, ideas of republicanism, liberalism, constitutionalism, or the Anglo-American concept of government. In this diploma paper, democracy and the rule of law are analyzed as concepts that have a general, i.e., global, meaning. Examples of elements typical of democracy and the rule of law are, however, the provisions of the Czech law. The aim of the diploma thesis is to point out the influence of historical experience on the development of ideas about democracy and the rule of law, and to emphasize the phenomena that are being studied, how they differ and how they interact. In conclusion, the historical development of both phenomena has led to a fundamental change in their understanding. Both terms are limiting and balancing each other. Demokracie a právní stát Diplomová práce se zabývá tématy demokracie, právního státu a jejich vzájemného působení. Práce se oběma tématům věnuje v kontextu jejich historického vývoje a dalších idejí, které jeden či druhý fenomén ovlivňovaly a ovlivňují. Z uvedeného důvodu se čtenář setká především s problematikou antického chápání demokracie, s idejemi republikanismu, liberalismu, konstitucionalismu či s angloamerickým pojetím vlády zákona. V diplomové práci jsou demokracie i právní stát rozebírány jako pojmy, které mají obecný, tj. celosvětový význam. Jako příklady prvků typických pro demokracii a pro právní stát však slouží zejména ustanovení českého právního řádu. Cílem diplomové práce je poukázat na to, jaký vliv má historická zkušenost na vývoj představ o demokracii a právním státu a zdůraznit, v čem jsou si zkoumané jevy podobné, v čem odlišné a jak se vzájemně ovlivňují. Závěrem je možné uvést, že historický vývoj obou zkoumaných jevů přinesl zásadní změnu v jejich chápání. Oba pojmy se navzájem omezují a vyvažují. V současnosti je demokracie chápána jako univerzální hodnota a společně s moderní koncepcí právního státu vytváří liberálně-demokratický systém vládnutí. Zároveň však oba fenomény čelí novým výzvám.
