Abstract

The name of the thesis: Specifics of consumer protection in the field of energy industry The thesis deals with the specific consumer protection in the field of energy industry - in the market with electricity, gas, and thermal energy. The goal of the thesis is a detailed analysis of the legal regulation of the most important consumers' rights and related obligations of the license holders and eventual problems of consumers occurring in the market with energy commodities, followed by an analysis of relevant jurisdiction. The first part is focused on the definition of primary participants entering the energetic market where the attention is focused on the customer - consumer and energy supplier. The second part defines relevant customers' rights, besides the right to connection to the power system it also closely analyses especially the so-called some measures to protect a customer, as regulated in Section 11a of the Energy Act, including the right of withdrawal, termination of contract, right of withdrawal when the price is increased or other contract conditions are changed. Název diplomové práce: Specifika ochrany spotřebitele v oblasti energetiky Tato práce se zabývá zvláštní ochranou spotřebitele v oblasti energetiky - na trhu s elektřinou, plynem a tepelnou energií. Cílem této práce je podrobná analýza právní úpravy nejdůležitějších práv spotřebitelů a jim odpovídajících povinností držitelů licencí a případných problémů pro spotřebitele vznikajících na trhu s energetickými komoditami, doprovázená rozborem příslušné judikatury. První část práce je zaměřena na vymezení základních účastníků vystupujících na energetickém trhu, kde je hlavní pozornost zaměřena na postavu zákazníka - spotřebitele a dodavatele energií. Druhá část práce vymezuje příslušná práva zákazníků, kde jsou kromě práva na připojení k energetické soustavě podrobně rozebrána především tzv. Některá opatření na ochranu zákazníka upravená v ustanovení § 11a energetického zákona, zahrnující právo na odstoupení od smlouvy, výpověď smlouvy a právo na odstoupení od smlouvy při zvýšení ceny nebo při změně jiných smluvních podmínek. Dále následuje rozbor některých povinností držitelů licencí. Kromě povinnosti informační je zde zmíněn i tzv. institut pokračování ve výkonu licencované činnosti, institut povinnosti nad rámec licence a institut dodavatele poslední instance.
