Výslechová praxe pracovníků zaměřených na oblast řešení případů týraných a zneužívaných dětí

Abstract

This diploma thesis is comprised of a theoretical section and a practical section. The first theoretical subchapter introduces the CAN syndrome. The second theoretical subchapter focuses on the relevant international and national child protection legislation. The third subchapter "Child Interrogation" deals with the issue of the historical development of child interrogation techniques and methods, and the currently recommended interrogation techniques used to interrogate children in keeping with the Act on Criminal Judicial Procedure No. 141/1961 in the Czech Republic. The third subchapter also concerns with the character traits of the investigator, the qualification requirements of this profession and the fundamental methodology used to prevent a child's secondary victimisation. The fourth theoretical subchapter focuses on the specially designed interrogation room used, among others, for child interrogation. The theoretical part is based on reference literature and relevant legislation. The practical section includes the results of qualitative research. Diplomová práce je složena z teoretické a praktické části. V teoretické části se zprvu zaměřuji na uvedení do problematiky týraných a zneužívaných dětí a na související mezinárodní i národní legislativu týkající se ochrany dětí a mladistvých a určující průběh výslechu nezletilých. Navazuje kapitola nazvaná Výslech dítěte, kde je z počátku uveden vývoj vedení výslechu dítěte a kde jsou uvedeny doporučené techniky a způsoby vedení průběhu výslechu dítěte v souladu s trestním řádem na území ČR. V této podkapitole jsou dále zahrnuty osobnostní charakteristiky vyšetřovatele, požadavky na tuto profesi a na koncepce, na jejichž základě se pracuje s dětmi tak, aby se zamezilo vzniku sekundární viktimizace dítěte. V poslední kapitole jsou popsána specifická pracoviště - speciální výslechové místnosti, ve kterých se mimo jiné vedou výslechy dětí. Hlavním zdrojem byla odborná literatura a právní předpisy s touto tématikou související. Praktická část zahrnuje výsledky kvalitativního výzkumu. První část je zaměřena na případy výslechů dětí týraných, zneužívaných či zanedbávaných a druhá část analýzu rozhovorů se šesti vyškolenými pracovníky, kteří informují o zkušenostech v problematice výslechové praxe u dětí na metodické i praktické úrovni.
