Abstract

Tvorba krajiny v právu Diplomová práce se zabývá tvorbou krajiny v právu. Cílem této diplomové práce je zjistit, zda je tvorba krajiny v českém právním řádu upravena a jakým způsobem. Jako svůj další cíl si diplomová práce stanovuje se samotnou právní úpravou podrobněji zabývat, provést její analýzu a v závěru této diplomové práce navrhnout možnosti jejího zlepšení. Diplomová práce je členěna do tří částí. První část diplomové práce se zabývá samotnou definicí krajiny. Do diplomové práce jsou vedle právní definice krajiny zahrnuty též definice, kterých je užíváno v jiných vědních oborech. Druhá část diplomové práce popisuje mezinárodněprávní úpravu tvorby krajiny. Podrobněji se tato část diplomové práce věnuje zejména Evropské úmluvě o krajině. Třetí část této diplomové práce se zabývá právní úpravou tvorby krajiny v českém právním řádu. Tato část se s ohledem na rozsah diplomové práce věnuje pouze veřejnoprávní úpravě tvorby krajiny v České republice. Zejména se zabývá právními nástroji územního plánování. Diplomová práce dále pojednává o nástrojích vodního a lesního plánování, které jsou s nástroji územního plánování propojeny. V závěru diplomová práce vyhodnocuje současný stav právní úpravy nástrojů k tvorbě krajiny v České republice a navrhuje zlepšení právní úpravy z pohledu de lege ferenda.

The creation of landscape in the law The diploma thesis deals with the creation of landscape in the law. The aim of this diploma thesis is to ascertain if the creation of landscape is provided by the Czech legal system and if so, in which ways. Another aim of the diploma thesis is to deal with the legislation in more detail, analyses it and suggests the possibilities of its improvement at the end of this diploma thesis. The diploma thesis is divided into three parts. The first part of the diploma thesis deals with the definition of landscape. The definitions that are used in other scientific disciplines are included in the diploma thesis next to the legal definition of landscape. The second part of the diploma thesis describes the international legislation of the creation of landscape. This part of the diploma thesis focuses particularly on the European Landscape Convention. The third part of the diploma thesis deals with legislation of the creation of landscape in the Czech legal system. With regard to the scope of the diploma thesis, this part only deals with the public law legislation of the creation of landscape in the Czech Republic.
