Půdní vestavba jako předmět občanskoprávních vztahů

Abstract

Aim of the thesis is a comprehensive view on the issue of construction of the attics flats, especially in view of civil law relations. This work contains a general explanation of the development of housing law in the Czech legal environment, the development of a contractual type of the agreement on the construction and finally also the analysis of essential requirements of agreements for the construction according to the applicable Civil Code. The thesis includes passages concerning the registration of ownership rights to the land registry, the issue of building permit procedure and tax aspects related to the construction of the attics apartments. Práce má za cíl komplexní pohled na problematiku výstavby půdních bytů zejména z pohledu občanskoprávních vztahů. Obsahem práce je obecný výklad o vývoji bytového práva v českém právním prostředí, dále vývoj smluvního typu smlouvy o výstavbě a konečně též rozbor náležitostí smlouvy o výstavbě podle aktuálně platného občanského zákoníku. Součástí práce jsou i pasáže zabývající se zápisem vlastnického práva od katastru nemovitostí, problematikou stavebního řízení a daňovými aspekty souvisejícími s výstavbou půdních bytů.
