Perspektivy evropského antidiskriminačního práva se zaměřením na aktuální legislativní návrhy

Abstract

The rigorous thesis "The perspectives of the European antidiscrimination law with focus on current legislative proposals" discusses the history of the development of European antidiscrimination law and outlines the problems with the proposal of the so-called fifth Equal Treatment Directive. After a brief summary of the history of the development of primary and secondary European law, the thesis concentrates on the content of the new Equal Treatment Directive and critically examines its most problematic aspects. The thesis analyses the positions of the Member States that expressed their disagreement with the content of the proposal. The thesis further deals with the process and result of the implementation of European antidiscrimination laws in three selected countries: Germany, Austria and the Czech Republic. At the end of the thesis I use the example of the United Kingdom, which has some of the most extensive antidiscrimination regulations in the European Union, to predict the possible further development of European antidiscrimination law.

Rigorózní práce na téma "Perspektivy evropského antidiskriminačního práva se zaměřením na aktuální legislativní návrhy" se zabývá dosavadním vývojem evropského antidiskriminačního práva a nastiňuje problematiku obsahu návrhu tzv. páté antidiskriminační směrnice. Po stručném shrnutí vývoje evropského primárního i sekundárního práva se práce zaměřuje na obsah nové antidiskriminační směrnice a kriticky vytyčuje její nejproblematičtější body. Jsou rozebrána stanoviska států, které se oficiálně vyjádřily proti návrhu směrnice. Následně se práce věnuje implementaci evropského antidiskriminačního práva ve vybraných evropských zemích - Německu, Rakousku a České republice. V závěru práce je nastíněn možný další vývoj evropského antidiskriminačního práva na příkladu Velké Británie, tedy jedné z nejextenzivnějších antidiskriminačních regulací v Evropě.
