Abstract

Shrnutí V oblasti bezpečnosti a ochrany zdraví při práci dochází ke kolizi dvou zájmů, a to dvou skupin subjektů. Mezi hlavní subjekty patří zaměstnavatelé na jednom konci, kontra zaměstnanci a společnost jako taková na konci druhém. Pokud jde o zájmy akcionářů, tak na jedné straně stojí zefektivnění výroby a tím maximalizaci zisku, na druhé straně zájem na maximalizaci bezpečnosti zaměstnanců, což je záležitost z právního i morálního hlediska nutná, ovšem značně nákladná. Řešení spočívá v kompromisu, situaci, kdy je zajištěna solidní bezpečnost při práci za rozumné výdaje. Za řešitele této situace je nutno považovat stát, který stojí někde uprostřed těchto subjektů a jejich zájmů a nelze jej jednoznačně postavit na stranu zaměstnanců, ani zaměstnavatelů, ale zato může svými veřejnoprávními zásahy ve formě zákonů a dalších právních předpisů stav bezpečnosti a ochrany zdraví při práci ovlivnit. Stát v sobě totiž také řeší protikladné postoje v tomto směru, a sice žádaná maximalizace zisku obchodních společností a tím co možná nejvyšší odvody na daních do státní pokladny, versus touha po co nejnižších výdajích z titulu důchodového a sociálního pojištění zaměstnancům a zájem na co nejdelším produktivním věku v životě každého jedince. Resumé A person could say that from one angle the whole situation of occupational safety and health leads to a collision of two different interests of two different subjects. The main subjects are employers on one side and employees and society as a whole on the other side. Speaking of interests, there is an interest of making the biggest possible earnings and maximalization of profit, but on the other side there is an interest of maximalization of safety of the employees as a very expensive part of the business but a necessary matter of humanism and law. The solution lays on a compromise, a situation, where there is a guarantee of good safety for a reasonable price. We have to see the state as the resolver of this situation because state is laying between these two subjects and their interests and we cannot place it on the side of emloyees or employers. On the other hand state can have a big influence on the whole situation due to its statutory instruments such as legal acts and other directives. State, however, also has to resolve some opposing views inside itself.
