Přednosti a nedostatky vybraných forem vlády - parlamentní republika vs. prezidentská republika - komparativní analýza

Abstract

Předkládaná diplomová práce se zabývá vybranými formami vlády a na konkrétních příkladech dvou států porovnává parlamentní a prezidentskou republiku. V první části je definován stát a jeho znaky, funkce a formy. Dále je pozornost věnována základním typům formy vlády, a sice monarchii a republice s přihlédnutím k jejich historickému a současnému pojetí. V kapitole zabývající se teorií dělby moci jsou konkretizovány jednotlivé orgány představující státní moc: moc zákonodárná, výkonná a soudní. Právě vztahy mezi orgány legislativy a exekutivy jsou klíčové pro vymezení formy vlády. Kromě typu parlamentní a prezidentské formy vlády se setkáváme např. s dualistickou monarchií, poloprezidentskou formou vlády a dalšími typy. Tato práce definuje, specifikuje, v reálné podobě konkretizuje a posléze porovnává vztahy mezi složkami moci zákonodárné a výkonné u vybraných států, tj. České republiky jako příkladu parlamentní formy vlády a Spojených států amerických, které se vyznačují prezidentským systémem. Závěrečná část práce se věnuje pedagogickému zařazení tématu do školního vzdělávání a nastiňuje vhodné metody a postupy, jak téma pojmout ve vyučování. Závěrem je třeba zmínit, že obě formy vlády mají své klady a zápory, a je velmi obtížné stanovit, která z forem vlády více odpovídá potřebám moderního státu. Záleží to...

The diploma thesis in question is focused on the selected forms of government: the parliamentary and the presidential republic. Before a comparative analysis of particular examples of states is done, other areas concerned with the topic have to be described. The first chapter depicts the state through its features, functions and forms. Then two essential forms of government - the monarchy and the republic - are specified in the historical and present context. The next chapter focuses on the model of separation of powers among the executive, legislative and judicial power, and specifies the relations between them. These relations shape the factual form of the government. Except the parliamentary and presidential system, other types of government are introduced, for example the dualistic monarchy, the semi-presidential republic etc. The aim of this work is to define, specify and compare the relations between the legislature and the executive in the Czech Republic and the United States of America. The result of the comparison is not evident because it is not possible to say which form is better.
