dc.description.abstractRole soudu v civilním sporném řízení při dokazování Abstrakt V této diplomové práci se zabývám rolí soudu v civilním sporném řízení při dokazování. Cílem práce je posoudit, v jakém rozmezí může soud překonat rámec zásady projednací a dispoziční. Pomocí analytické metody se snažím shrnout, kdy je důležitá angažovanost soudce i mimo vymezený předmět sporu. Zkoumám průběh celého důkazního řízení a snažím se vymezit, ve které fázi má soud větší volnost a může se více zabývat svými subjektivními zkušenostmi oproti fázím, kdy musí striktně dodržovat zákon z důvodu dodržování ústavně zakotvených práv a svobod. V první části práce rozebírá dotazovací, vysvětlovací a poučovací povinnost soudu. Tyto mechanismy slouží k navigování účastníků řízením a k prevenci vydání překvapivých rozhodnutí. Zvláštní pozornost je věnována poučení o důkazním břemenu podle § 118a o.s.ř., které vnímám jako klíčový prvek ochrany procesních práv. Práce dále zkoumá limity soudní iniciativy ex officio a zdůrazňuje, že vlastní vyhledávání důkazů soudem musí zůstat výjimečným korektivem, aby nebyla ohrožena nestrannost soudce. Další oddíl je věnován ústavněprávním základům dokazování, zejména principu rovnosti zbraní a fenoménu opomenutých důkazů. dc.description.abstractThe role of the court in civil litigation in the taking of evidence Abstract In this thesis, I examine the role of the court in civil litigation with regard to the taking of evidence. The aim of this thesis is to assess the extent to which a court may go beyond the scope of the principles of admissibility and disposition. Using an analytical approach, I seek to summarize when a judge's involvement is important even beyond the defined subject matter of the dispute. I examine the entire course of the evidentiary proceedings and attempt to define in which phase the court has greater discretion and can rely more on its subjective experience, as opposed to phases in which it must strictly adhere to the law in order to uphold constitutionally guaranteed rights and freedoms. In the first part of this thesis, I analyze the court's duty to inquire, explain, and instruct. These mechanisms serve to guide the parties through the proceedings and to prevent the issuance of unexpected decisions. Particular attention is paid to the instruction regarding the burden of proof under Section 118a of the Code of Civil Procedure, which I view as a key element in the protection of procedural rights.
