dc.description.abstractDruhy reorganizace a modality jejího provádění Abstrakt Tato diplomová práce je tematicky zaměřena na reorganizaci jako sanační způsob řešení úpadku v českém insolvenčním právu, a to zejména z pohledu její vnitřní diferenciace a konkrétních modalit jejího provádění. Reorganizace představuje komplexní institut, jehož cílem je zachovat provoz ekonomicky životaschopného podniku při současném co nejvyšším uspokojení věřitelů. Práce usiluje o systematické uchopení tohoto institutu, o vymezení jeho jednotlivých druhů a o analýzu rozdílů mezi nimi. Zároveň se zaměřuje na praktické fungování reorganizace v konkrétních insolvenčních řízeních a reflektuje vybrané interpretační otázky současné právní úpravy. Práce je členěna do několika tematických celků, které na sebe logicky navazují. Úvodní část vymezuje pojem reorganizace, její postavení mezi způsoby řešení úpadku a základní principy, na nichž je vystavěna, zejména princip zachování podniku jako "going concern" a princip rovnosti věřitelů. Následující kapitoly se věnují přípustnosti reorganizace, podmínkám pro podání návrhu na její povolení a samotnému průběhu reorganizačního procesu, včetně role insolvenčního soudu, insolvenčního správce a věřitelských orgánů. dc.description.abstract1 Types of Reorganization (within Czech Insolvency Proceedings) and Modalities of its Implementation Abstract This diploma thesis focuses on reorganization as a restructuring method of resolving insolvency under Czech insolvency law, particularly from the perspective of its internal differentiation and the specific modalities of its implementation. Reorganization represents a complex legal instrument aimed at preserving the operation of an economically viable enterprise while ensuring the highest possible satisfaction of creditors. The thesis seeks to provide a systematic analysis of this institute, to define its individual types, and to examine the differences between them. At the same time, it addresses the practical functioning of reorganization in specific insolvency proceedings and reflects on selected interpretative issues arising from the current legal framework. The thesis is divided into several thematic sections that logically build upon one another. The introductory part defines the concept of reorganization, its position among the methods of resolving insolvency, and the fundamental principles on which it is based, particularly the "going concern" principle and the principle of equality of creditors.
