dc.description.abstractAgreements for Work Performed Outside the Employment Relationship Abstract This thesis provides a critical assessment of the current status of agreements on work performed outside an employment relationship in the Czech legal order, with a particular focus on the changes introduced by Act No. 281/2023 Coll., which implemented a transposition amendment to the Labour Code, as well as subsequent legislative developments following this amendment. The thesis is structured into three parts. The first part sets out the historical and legal background necessary for a proper understanding of the institute and the reasons for its establishment. It traces the development of these agreements from their initial incorporation into Act No. 65/1965 Coll., the Labour Code, where they were conceived as an exceptional instrument intended to address specific labour needs of employers, through to the current regulation under Act No. 262/2006 Coll., the Labour Code. Particular attention is paid to how the degree of contractual freedom and employee protection has evolved over time and how these agreements have, in practice, developed from a supplementary instrument into a commonly used and, in certain situations, misused form of dependent work. dc.description.abstractDohody o pracích konaných mimo pracovní poměr Abstrakt Diplomová práce nabízí kritické zhodnocení současného postavení dohod o pracích konaných mimo pracovní poměr v českém právním řádu se zvláštním důrazem na změny spojené s transpoziční novelou zákoníku práce provedenou zákonem č. 281/2023 Sb. a na ni navazujícími změnami. Práce je členěna na tři části. Východiskem pro správné pochopení institutu a důvodů jeho vzniku je historicko-právní analýza obsažená v první části diplomové práce, která sleduje vývoj dohod od jejich prvního zařazení do zákona č. 65/1965 Sb., zákoník práce, kdy byly koncipovány jako výjimečný institut pro zajištění specifických pracovních potřeb zaměstnavatelů, až po současnou úpravu v zákoně č. 262/2006 Sb., zákoník práce. Zvláštní pozornost je věnována tomu, jak se postupně měnila míra smluvní volnosti a ochrany zaměstnance a jak se dohody v praxi vyvinuly z institutu původně doplňkového charakteru v běžně využívanou, respektive v určitých situacích zneužívanou, formu výkonu závislé práce. Těžištěm diplomové práce je druhá část, jež obsahuje kritické zhodnocení vybraných změn zavedených v posledních letech, jejichž důsledkem je přiblížení institutu dohod právnímu režimu pracovního poměru.
