dc.description.abstractDigital constitutionalism: freedom of expression and content moderation Abstract The impact of digital platforms on society, the economy and legal systems has become a fundamental topic of contemporary legal theory and practice. With the development of an algorithmic society, where computational mechanisms govern important aspects of the public and private sphere, there is an increasing need to clearly define the responsibilities of platforms and the protection of users' fundamental rights. This work is devoted to the position of online platforms in the European legal framework, with a focus on the Digital Services Act (DSA). It examines how the DSA redefines the rules of liability of platforms, the means by which it increases the transparency of algorithmic decision-making and whether it is able to effectively protect users' fundamental rights. The literature to date has extensively addressed issues of regulation of digital platforms, with major studies focusing in particular on constitutional challenges in the algorithmic society (Constitutional Challenges Algorithmic Society), digital constitutionalism in Europe with an emphasis on the protection of personal data (Digital Constitutionalism in Europe) or the judicial protection of fundamental rights on the Internet (Judicial Protection of Fundamental...en_US
dc.description.abstractDigitální konstitucionalismus: svoboda projevu a moderace obsahu Abstrakt Vliv digitálních platforem na společnost, ekonomiku a právní systémy se stal zásadním tématem současné právní teorie i praxe. S rozvojem algoritmické společnosti, kde významné aspekty veřejné i soukromé sféry řídí výpočetní mechanismy, vzrůstá potřeba jasně vymezit odpovědnost platforem a ochranu základních práv uživatelů. Tato práce se věnuje postavení online platforem v evropském právním rámci, se zaměřením na Nařízení o digitálních službách (DSA). Zkoumá, jak DSA redefinuje pravidla odpovědnosti platforem, jakými prostředky zvyšuje transparentnost algoritmického rozhodování a zda je schopno účinně chránit základní práva uživatelů. Dosavadní literatura intenzivně zpracovává otázky regulace digitálních platforem, přičemž významné studie se věnují zejména ústavním výzvám v algoritmické společnosti (Constitutional Challenges Algorithmic Society), digitálnímu konstitucionalismu v Evropě s důrazem na ochranu osobních údajů (Digital Constitutionalism in Europe) či na soudní ochraně základních práv na internetu (Judicial Protection of Fundamental Rights on the Internet: A Road Towards Digital Constitutionalism?).
