Spolupracující obviněný

Abstract

Cílem této diplomové práce je analýza institutu spolupracujícího obviněného, jakožto legálního prostředku pro boj s organizovaným zločinem nejen v právních předpisech České republiky, ale i v právních úpravách dalších evropských států. Součástí práce je také nastínění vzniku a vývoje tohoto institutu, a to jak v kontextu mezinárodním, tak i v kontextu legislativy české, včetně novelizací a návrhů de lege ferenda. Ve své práci se věnuji také komparaci české úpravy s konkrétními národními úpravami. Zmiňuji také některé zajímavé právní kauzy, které se k problematice vztahují a prezentuji názory vědeckých kapacit či respektovaných odborníků. Diplomová práce je rozdělena do pěti kapitol, které jsou doplněny úvodem a závěrem. První kapitola se věnuje historickému vývoji daného institutu, a to jak v rámci České republiky, tak na území ostatních států. Ve druhé kapitole se zabývám českou právní úpravou, zavedením institutu, novelizací a souvislostmi s ustanoveními a zákony mimo Trestní řád. Taktéž předkládám některé názory odborníků, kteří hodnotí institut z nejrůznějších úhlů pohledu a vyjadřují svůj názor de lege ferenda. Ve třetí kapitole prezentuji problematiku organizovaného zločinu, který s tématem úzce souvisí; institut spolupracujícího obviněného pomáhá při odhalování a dokazování tohoto druhu...

The aim of this thesis is the analysis of a cooperating defendant as a legal instrument of combating organized crime not only in the law regulations of the Czech Republic, but also in the laws of other European countries. This thesis also outlines the origin and development of this institution, both in the international context and in the context of the Czech legislation, including amendments and proposals de lege ferenda. In my work I am also comparing the Czech legislation with specific national legislations. I also mention some interesting legal cases that relate to these issues and present the views of the scientific capacities and respected experts. The thesis is divided into five chapters, which are complemented by introduction and conclusion. The first chapter deals with the historical development of the institute, both in the Czech Republic and in the territories of other states. The second chapter deals with the Czech legislation, the introduction of the institute, and amendments regarding also the laws outside of the Criminal Procedure Code. I also bring up some of the views of experts who evaluate the institute from various angles and express their opinion de lege ferenda.
