dc.description.abstract1 Legal Certainty and the Regulation of Residential Tenancy in Theory and Practice Abstract This thesis addresses the issue of legal certainty in rental housing in the Czech Republic, with particular focus on the practice commonly referred to as the "chaining of fixed-term lease agreements". This practice raises serious concerns regarding the position of the tenant as the weaker contracting party and the overall stability of tenancy relationships. The aim of the thesis is to analyse the current legal framework governing residential leases, especially in terms of the balance between the principle of contractual freedom and the need to protect the tenant as the weaker party in the contractual relationship. The thesis seeks to assess whether the current legal framework adequately reflects the dynamics and specifics of the current rental housing market, while ensuring sufficient guarantees of legal certainty and stability for both parties. Based on this assessment, the thesis further identifies practical issues arising from the current legal regulation, particularly in relation to the frequent use of fixed-term contracts in successive sequences. dc.description.abstract1 Právní jistota a úprava nájmu bytu v teorii a praxi Abstrakt Diplomová práce se věnuje otázce právní jistoty nájemního bydlení v České republice, přičemž těžištěm této diplomové práce je praxe zvaná řetězení nájemních smluv. Tato praxe vyvolává závažné otázky týkající se postavení nájemce jako slabší smluvní strany a celkové stability nájemních vztahů. Cílem této diplomové práce je podrobit analýze platnou právní úpravu nájmu bytu, a to především z hlediska vyváženosti mezi principem smluvní volnosti a potřebou ochrany nájemce jakožto slabší smluvní strany. Práce usiluje o zhodnocení, zda současný právní rámec odpovídajícím způsobem reflektuje dynamiku a specifika současného trhu s nájemním bydlením, a zároveň poskytuje dostatečné záruky právní jistoty a stability oběma smluvním stranám. Na základě této analýzy se práce dále zaměřuje na identifikaci praktických problémů, které z této právní úpravy v praxi vyplývají. Práce je strukturována do čtyř tematických částí. První část poskytuje teoretický výklad klíčových právních institutů, které formují rozdíly mezi nájmy na dobu určitou a neurčitou. Druhá část se zabývá praktickými aspekty řetězení nájemních smluv a motivacemi, které vedou pronajímatele k preferenci smluv na dobu určitou.
