Abstract

Legal aspects of psychological manipulation in new religious movement Abstract The diploma thesis deals with the issue of psychological manipulation in the environment of new religious movements, possibilities and limits of its legal grasp in the Czech legal system. The thesis is divided into sociological-religious, psychological and legal part. The work includes the definition of new religious movements, their history, typology and analysis of psychological mechanisms leading to manipulation and dependence of members on the group. The third part, which builds on the previous two parts, examines the legal aspects of psychological manipulation in new religious movements from the perspective of different branches of law, especially criminal law. The thesis concludes with a comparison with the current wording of the diametrically opposed French legislation. Specific legal institutes are used to show how the legislator tries to respond to the phenomenon of so-called "destructive cults". The thesis presents the threefold regime of the existence of new religious movements in the Czech environment and the shortcomings of this model. Právní aspekty psychické manipulace v nových náboženských hnutích Abstrakt Diplomová práce se zabývá problematikou psychické manipulace v prostředí nových náboženských hnutí, možnostmi a limity jejího právního uchopení v českém právním řádu. Práce je rozdělena na sociologicko-religionistickou, psychologickou a právní část. Součástí práce je definice nových náboženských hnutí, jejich historie, typologie a analýza psychologických mechanismů vedoucích k manipulaci a závislosti členů na skupině. Třetí část, která z předešlých dvou částí vychází, se věnuje právním aspektům psychické manipulace v nových náboženských hnutí z pohledu jednotlivých právních odvětví, především pak trestního práva. V závěru práce je představena komparace s aktuálním zněním diametrálně odlišné francouzské právní úpravy. Na konkrétních právních institutech je ukázáno, jak se zákonodárce snaží reagovat na fenomén tzv. "destruktivních kultů". Práce představuje trojí režim existence nových náboženských hnutí v českém prostředí a nedostatky tohoto modelu. V poslední části kapitoly věnující se analýze současného stavu českého právního řádu je demonstrován přesah problematiky psychické manipulace v nových náboženských hnutích do základních lidských práv a svobod, především pak do svobody myšlení, svědomí a náboženského vyznání.
