Abstract

This master's thesis examines the ethical boundaries and specifics of judges, prosecutors, and attorneys presenting themselves on social media platforms. The thesis focuses on the regulation of this conduct through legal provisions, ethical codes, and other recommendations. It is stated that there are significant differences in the extent and form of regulation for individual professions, reflecting different societal demands. The regulation for judges is the most elaborate and strictest, with an emphasis on preserving the dignity of the office, impartiality, and independence. For prosecutors, the regulation is less detailed, recommending restraint and not emphasizing professional identity in the online space. For attorneys, given their status as independent professionals and the need to acquire clients, general provisions of the ethical code regarding dignity and publicity rules are applied. The thesis points out the inconsistent interpretation of rules in practice for judges and the lack of specific recommendations for prosecutors and attorneys. Tato diplomová práce se zabývá etickými limity a specifiky prezentace soudců, státních zástupců a advokátů na platformách sociálních médií. Práce se zaměřuje na to, jak je toto chování regulováno prostřednictvím zákonných ustanovení, etických kodexů a dalších doporučení. Analýza odhaluje podstatné rozdíly v intenzitě a způsobu regulace mezi jednotlivými právnickými profesemi, což odráží rozdílná společenská očekávání. Nejpropracovanější a nejpřísnější pravidla platí pro soudce, s akcentem na zachování důstojnosti funkce, nestrannost a nezávislost. U státních zástupců je regulace méně detailní, doporučuje se zdrženlivost a nevyzdvihování profesní identity v online prostoru. Pro advokáty, s ohledem na jejich postavení svobodného povolání a potřebě akvizice klientů, se aplikují obecná ustanovení etického kodexu o důstojnosti a pravidel publicity. Práce poukazuje na nekonzistentní interpretaci pravidel v praxi u soudců a na nedostatek specifických doporučení pro státní zástupce a advokáty. Zdůrazňuje význam důstojnosti napříč všemi profesemi pro zachování důvěry veřejnosti v justici. S ohledem na to je profesní status právníků relevantní i v jejich osobním životě, a to působení na sociálních sítích nevyjímaje.
