57 7. ZÁVĚR Téma výslechu dětí je velmi zajímavé a jeho problematika velmi důležitá. Touto prací jsem se snažila předmětnou látku přehledně obsáhnout. Výslech znamená pro každého bez rozdílu věku svým způsobem zátěžovou situaci. Člověk obvykle vstupuje do pro něj neznámého prostředí, neboť jednání s orgány činnými v trestním řízení nebývá na každodenním pořádku naopak se jedná spíše o situaci výjimečnou. U dětí to podle mého názoru platí dvojnásob. Už jen to, že vypovídají znamená, že byly buď svědky nebo v horším případě přímo oběťmi trestného činu. Výjimečně mohly i děti být pachateli činů jinak trestných dle trestního zákona, ale to na nutnosti zvláštního vedení výslechu nic nemění. Proto oceňuji projekt nadace Naše dítě, která vydala brožuru Průvodce dětského svědka v trestním řízení, kde je názornou a pro dítě jednoduše pochopitelnou formou vysvětleno, co dítě může očekávat, pokud bude vypovídat na policii nebo u soudu.69 Správné provedení výslechu dítěte v roli svědka nebo oběti je zcela zásadní. Jeho cílem a smyslem je, aby dítě již nemuselo o svých nepříjemných zážitcích v dalším průběhu řízení vypovídat. Zákonný požadavek, aby dítě bylo v průběhu trestního řízení nuceno vypovídat zpravidla pouze jednou, je bohužel v praxi zneužíván a děti jsou často vyslýchány opakovaně, čímž se jejich vzpomínky na...

62 8. SUMMARY The theme of my Thesis is The Peculiarities of Interrogation of Children. In the introduction of my Thesis I present the reasons which led me to the choice of the theme of my Thesis and describe the division of the Thesis into particular chapters. The second chapter deals with the interrogation in general and its definition, targets, subject and with the division of the interrogation into particular kinds from various points of view. The third chapter contains the interpretation of the term Child in accordance with the Czech law, the criminal procedural regulation of interrogation of children and also the periodization of the child's age based on the stages of development of the human psyche. The forth chapter concerns the preparation of the interrogation, division of the preparation of the interrogation into analytic and synthetic part and with particularities which must be obeyed by the interrogator before the beginning of the interrogation itself. This chapter also deals with the role of the room specially modified for the interrogation of children and the means of the documentation of the interrogation of children.
