Srovnání právní úpravy základních institutů bytového družstva v Polsku a v České republice

Abstract

Zakladni aspekty pravnich uprav bytovych družstev v Česke republice a v Polsku byly ve svych zakladni obrysech představeny vyše. Aby však byl naplněn smysl celého tematu teto diplomove prace, je nutno z jejich srovnani vyvodit určity zavěr. Počatky modernich bytovych družstev se v obou zemich vyvozovaly ze zcela různych historickych okolnosti. Polsko se po druhe světove valce jen těžko vzpamatovavalo z nasledků valečnych škod, tzn. i stav bytoveho fondu byl v teto době zcela nedostatečny a celkova bytova situace teměř kriticka. Opačny stav ovšem shledavame v tehdejšim Československu. Valečne ztraty byly nesrovnatelně nižši oproti škodam v Polsku, navic v důsledku vysidleni pohraničnich oblasti bylo bytů dostatek. Tyto rozdilne podminky, ktere tvořily pomyslnou startovni čaru vzniku moderního bytoveho družstevnictvi v obou srovnavanych statech, mohly byt důvodem k přijeti rozdilnych opatřeni v ramci upravy družstev. Avšak v cele povalečne době se neobjevily zvlaště vyznamne principialni rozdilnosti v charakteru upravy družstevnich vztahů. Obě současne pravni upravy jsou předevšim založeny na odstraněni deformaci předchozích systemů a na uplatňovani mezinarodně uznavanych družstevnich zasad, ať již jsou v pravnich normach explicitně vyjadřeny, či nikoli. THE COLLATION A REGULATION OF FUNDAMENTAL INSTITUTES OF HOUSING COOPERATIVES IN POLAND AND THE CZECH REPUBLIC This work aims to capture qualities and shortcomings of the legislation in one of the important sectors of housing, the cooperative sector, in the context of a comparison of the two national legislations - in the Czech Republic and Poland. In both compared legislations, cooperative has its special character and long-standing tradition, which was introduced immediately in the introductory sections. The cooperative sector is the merit of this work. The issue of housing is always up to date, moreover, in practice we many time encounter with the uncertainties associated with the housing issue. Cooperative law in the area of housing is interesting in particular, with regard to incompleteness, and, in some cases, to insufficiency of Czech legislation, distinguish it from, more or less, consistent realization of housing cooperatives in Poland.
