Abstract

Performers' rights and their protection in the sphere of the internet and social networking services Abstract This thesis explores aspects of performers' legal status in the digital era. Massive expansion of the internet and social networking services in recent decades poses many challenges for the copyright law and neighbouring rights. The thesis investigates the most frequent means in which protected performances can be used and performers can exercise their rights in the cyberspace. Also there is an analysis of current European and Czech legislation that apply to this matter. Special attention is focused on the ways these legal texts reflect on peculiarities of the digital world. The thesis also researches aspects of performers' personality protection, such as their reputation and honour in the sphere of the internet and social networking sites. The thesis is divided into five chapters. The first chapter describes brief history and technical aspects of the internet. Essencial concepts of information technology law are also included. Legal regulation of neighbouring rights applicable to performers is explored in the second chapter. Práva výkonných umělců a jejich ochrana ve sféře internetu a sociálních sítí Abstrakt Tato diplomová práce se zabývá aspekty právního postavení výkonného umělce v digitální době. Masivní rozvoj internetu a sociálních sítí staví tradiční instituty autorského práva a práv souvisejících před stále nové výzvy. Práce mapuje způsoby, jakými může výkonný umělec užít své výkony v kybernetickém prostředí a analyzuje právní předpisy Evropské unie a České republiky, které se věnují této problematice. Zvláštní pozornost je věnována způsobům, jakými reflektují specifika virtuálního světa. Tato práce též zkoumá otázky spojené s všeobecnou ochranou osobnosti umělce ve sféře internetu a sociálních sítí. Práce je členěna do pěti částí. První se zabývá historií a technickou stránkou internetu, dále jsou v ní vymezeny základní pojmy práva informačních technologií. Druhá část popisuje základní pojmy upravující právní postavení výkonného umělce v českém právním řádu. Dále je zde popsán historický vývoj právní úpravy výkonného umělce v systémech českého a československého práva. Třetí část se zabývá jak základními, tak i specifickými způsoby užití uměleckého výkonu v kybernetickém prostředí.
