Abstract

Regulatory Sandbox in Financial Services This thesis examines the issue of regulatory sandboxes in financial services. A regulatory sandbox is a legal framework under which innovative technologies, products or services can be tested in a real environment and on real customers. Sandboxes are emerging in areas that are heavily regulated, while in financial services they serve to make it easier for innovative companies to navigate regulation and enter the market. This work then focuses on regulatory sandboxes in financial services in the European Union, which are currently established in 11 Member States. The main objective of this thesis is firstly to introduce this relatively widespread but not well-known concept and secondly to analyse its use in financial services. Although the establishment of a regulatory sandbox in the Czech Republic has been debated, it is a rather unknown and unexplored concept in the Czech academic environment, but one which deserves appropriate attention. Especially if it were to be established in the Czech Republic. The first chapter is dedicated to the regulatory sandbox itself, its functioning and the various benefits and risks associated with its operation. Regulatorní sandbox ve finančních službách Tato diplomová práce se zabývá problematikou tzv. regulatorních sandboxů ve finančních službách. Regulatorní sandbox, někdy nazýván také jako "regulatorní pískoviště", je právní rámec, na jehož základě je možné testovat inovativní technologie, produkty nebo služby v reálném prostředí a na reálných zákaznících. Sandboxy se objevují v oblastech, které jsou silně regulované, přičemž ve finančních službách slouží právě k tomu, aby usnadňovaly inovativním společnostem orientaci v regulaci a vstup na trh. Tato práce se pak soustředí na regulatorní sandboxy ve finančních službách v Evropské unii, které jsou v současnosti zřízeny v 11 členských státech. Hlavním cílem této diplomové práce je jednak představení tohoto poměrně rozšířeného, ale nepříliš známého institutu, a jednak analýza jeho využití ve finančních službách. Ačkoliv se totiž o zřízení regulatorního sandboxu v České republice vedou debaty, v českém akademickém prostředí se jedná o doposud spíše neznámý a neprozkoumaný institut, který si ale zaslouží příslušnou pozornost. Zejména, pokud by opravdu došlo k jeho zřízení v ČR. První kapitola se věnuje samotnému institutu regulatorního sandboxu, jeho fungování a různým přínosům a rizikům spojeným s jeho provozem.
