Abstract

Parliament of the Czech Republic and the European Union ABSTRACT What are the effects of European integration on the functioning of the Parliament of the Czech Republic and how does the European law set the boundaries for the involvement of this key constitutional institution in European affairs? To what extent do the Chamber of Deputies and the Senate deal with the European agenda and engage in European Union policy-making, and are there differences between them in this respect? What is the role of both chambers in the European legislative process and what is the level of their activity compared to the activity of parliamentary chambers of other EU member states? The search for answers to these questions is the focus of this thesis. The first part of this thesis defines the concept of a parliament and its functions and powers as understood in theory, followed by a general characterisation of the Parliament of the Czech Republic, its two chambers and the constitutional basis for their involvment in European affairs. The second part introduces the major milestones in the history of European integration that have shaped the relationship between the Parliament of the Czech Republic and the European Union and an assessment of their impact on the functioning of national parliaments. Parlament ČR a Evropská unie ABSTRAKT Jaké dopady má evropská integrace na fungování Parlamentu ČR a jakým způsobem evropské právo vytyčuje mantinely pro zapojení klíčového ústavního orgánu do evropských záležitostí? Nakolik se Poslanecká sněmovna a Senát zabývají evropskou agendou a zapojují se do tvorby politik Evropské unie a jsou mezi nimi v tomto ohledu rozdíly? Jaká je role obou komor v evropském legislativním procesu a míra aktivity v porovnání s parlamentními komorami ostatních členských zemí Evropské unie? Hledáním odpovědí na uvedené otázky se zabývá tato diplomová práce. V první části této práce je vymezen pojem parlamentu a jeho funkcí a pravomocí tak, jak je chápán teorií, následuje obecná charakteristika Parlamentu ČR, obou jeho komor a ústavních základů pro projednávání evropských záležitostí. Druhá část představí zásadní milníky v historii evropské integrace, které formovaly vzájemný vztah Parlamentu ČR a Evropské unie a zhodnocení jejich dopadů na fungování parlamentů členských států. V třetí části je provedena analýza primárního práva a identifikace hlavních způsobů, jakými mohou národní parlamenty ovlivnit dění na evropské úrovni.
