Úpravy volebního práva ve státu Texas a jejich dopad na elektorát

Abstract

This bachelor thesis deals with the topic of changes in the electoral system of state Texas and their potential impact on its' electorate. This thesis describes the historical context of the voting law, as well as the current situation regarding this matter. It also presents the most important statutory changes that exist on the federal level of the voting law and also the demographics of the state of Texas to better illustrate the social context. In particular, greater attention is given to two specific aspects of the voting law, namely Absentee Ballot and voter identification laws, the so-called Voter ID Laws. These aspects of voting rights have begun to re-emerge at the forefront of the voting rights debate as a result of the Covid-19 pandemic and the associated 2020 U.S. presidential election. Both of these phenomena are described in terms of their current regulation in the state of Texas and their potential impact on the electorate. The thesis concludes that both of these aspects of suffrage exist in Texas in a fairly strict form. In doing so, according to the researches mentioned, the absence of such statutory regulation, or its change, could theoretically lead to increased voter turnout and thus expand access to the franchise to other eligible voters. Tato bakalářská práce se zabývá úpravami volebního práva ve státu Texas a jejich potencionálním dopadem na tamní elektorát. V práci je popsán jak historický kontext volebního práva, tak i současná situace. Dále je představeno, jaká nejdůležitější zákonná úprava v rámci volebního práva existuje na federální úrovni a prostor je věnován i demografii státu Texas, pro dokreslení sociálního kontextu. Největší pozornost je však věnována zejména dvěma aspektům volebního práva, a to volbě bez osobní účasti voliče, tzv. Absentee Ballot a zákonům o identifikaci voličů, tzv. Voter ID Laws. Tyto aspekty volebního práva se začaly znovu dostávat do popředí diskuse o volebním právu jako důsledek pandemie Covidu-19 a s tím spojenými prezidentskými volbami, které v USA proběhly roku 2020. Oba tyto fenomény jsou popsány jak z hlediska jejich aktuální úpravy ve státu Texas, tak z hlediska jejich možných dopadů na elektorát. Práce došla k závěru, že oba tyto aspekty volebního práva existují v Texasu v poměrně striktní formě. Přičemž dle uvedených výzkumů by absence takové zákonné úpravy, či její změna, mohla teoreticky vést ke zvýšení volební účasti, a tak tedy i k rozšíření přístupu k volebnímu právu na další oprávněné voliče.
