Abstract

Princip rovného zacházení a zákaz diskriminace v pracovněprávních vztazích Abstrakt Princip rovného zacházení a zákaz diskriminace lze chápat jako jeden z nejvýznamnějších principů pracovního práva. Rigorózní práce si klade za cíl komplexně informovat o tomto tématu a ukázat jeho promítnutí v jednotlivých právních dokumentech a rozhodovací praxi. Vlastní text je rozdělen do šesti kapitol, kterým předchází úvod a uzavírá je závěr. První kapitola se zabývá základními pojmy, jako je rovnost, rovné zacházení, diskriminace a další související pojmy. Dále obsahuje klasifikaci těchto pojmů a jejich definování. Druhá kapitola obsahuje promítnutí principu rovného zacházení a zákazu diskriminace na mezinárodní úrovni. Dané téma je zde zkoumáno na podkladě mezinárodních organizací, jako je Organizace spojených národů, Mezinárodní organizace práce a Rada Evropy. Součástí kapitoly je i podrobné popsání jednotlivých mezinárodních dokumentů upravujících dotčenou materii. Třetí kapitola se věnuje dané úpravě na evropské úrovni. Zde je poskytnut i komplexní výčet nejdůležitějších dokumentů evropského práva, ať už práva primárního, tak i sekundárního. The principle of equal treatment and prohibition of discrimination in labour relations Abstract The principle of equal treatment and prohibition of discrimination is considered as one of the most important principles of labor law. The aim of this thesis is to give a comprehensive informational overview on this topic and showcase its projection into legal documents and decision-making practice. The text itself is divided into six chapters, which precede the introduction and conclude the conclusion. The first chapter deals with the key terms such as equality, equal treatment, discrimination and other related concepts. It also contains classification of these terms and their definition. The second chapter focuses on the projection of the equal treatment and non- discrimination principles at the international level. The basis of international organizations such as the United Nations, the International Labor Organization and the Council of Europe are the examined subjects. Detailed descriptions of the various international documents dealing with this matter are discussed further in this chapter as well.
