Abstract

Role ústavních orgánů při zajišťování bezpečnosti státu Abstrakt Tato diplomová práce se zabývá otázkou, jakou úlohu v bezpečnostním systému České republiky hrají jednotlivé ústavní orgány, konkrétně prezident republiky, vláda, Parlament a Bezpečnostní rada státu. Za tímto účelem je nejprve zobrazen ústavní systém České republiky na příkladu postavení prezidenta republiky. Hlavní část práce je věnována analýze postavení prezidenta republiky jako vrchního velitele ozbrojených sil, neboť této kompetenci nebylo v české vědě ústavního práva dosud věnováno komplexní pozornosti. Z tohoto důvodu jsou shrnuty poznatky z československé ústavní historie, které jsou dále využity pro komparaci se stávající právní úpravou. Práce z ústavněprávního hlediska za použití všech obvyklých právních výkladových metod a poznatků jiných vědních oborů vykládá pojmy "ozbrojené síly" a "vrchní velitel." Na takto provedený výklad navazuje kritika podústavní právní úpravy a stanovení obsahu vrchní velitelské pravomoci. Text dále popisuje další činnosti prezidenta republiky s bezpečnostním rozměrem, zejména odůvodňuje jeho oprávnění ve vztahu ke zpravodajským službám. V druhé kapitole jsou rozebírány dvě zvláštní kompetence vlády a Parlamentu, a sice pravomoc rozhodovat zásadní bezpečnostní otázky a činnost při civilní a demokratické...

1 The Role of Constitutional Organs in Ensuring the State Security Abstract This diploma thesis deals with question, what role are constitutional organs, such as President of the Republic, Government, Parliament and Security Council of the State, playing in the security system of the Czech Republic. For this purpose, the thesis shows the constitutional system of the Czech Republic on the example of position of President of the Republic. Main part of the thesis is based on analysis of President's status as Commander in Chief of armed forces because of the lack of complex attention of Czech constitutional doctrine. According to that, the thesis describes Czechoslovak constitutional development in the first place and compares it with present legal framework. The thesis uses all methods of legal interpretation from the constitutional point of view as well as knowledges of other academic disciplines and interprets the constitutional terms "armed forces" and "Commander in Chief". This interpretation is followed by the criticism of statutory regulation and assess the content of Commander in Chief`s authority.
